Lt. Cedric Anderson of the Auburn Police Division said the fires were quickly put out by the fire units and that there wasn’t any serious damage to the trees or to the surrounding property as far as he could see.
“There may be some scorch or soot marks from the tissue burning, but the trees are fine, or appear to be,” Anderson said.
It can be easy for the toilet paper streamed across the trees to accidently get caught on fire, Anderson said, and that it has actually happened in the past before, though he couldn’t remember exactly when. Regardless, Anderson said incidents like these are always looked into to make sure there is no criminal mischief involved.
“Right now, that is something we don’t want to speculate about,” Anderson said. “We want to give the investigation a chance to produce some hard facts to indicate one way or the other.”
In that light, the case is still under investigation and all options are being considered in the incident.
“As it stands now, we have not been able to say if it has been intentional or not,” Anderson said. “Hopefully, with the assistance of the community, we will be able to make that determination in the near future.”
Mike Clardy, AU director of communications and marketing, said that in light of the recent incident, a member of the Toomer’s Oaks Task Force may possibly come to assess the damage the trees have endured. No other comment was given on the situation by the University until more information is gathered.
In 2010, Alabama fan Harvey Updyke was arrested for allegedly poisoning the trees. He is currently seeking temporary release to receive medical treatment. A date for the trial has yet to be set. A public meeting to discuss the future of the oaks has been set for Nov. 27 at Foy Hall.

They legally have to say "allegedly" since he hasn't been to trial yet. Since he hasn't posted bail ($50,000, so he'd have to pay $5,000), yes he's being held.
He poisoned the trees with a highly potent and controlled pesticide that has the potential to seep into the water supply and could cause a great deal of harm if ingested.
Since this is vandalism, he was charged with criminal mischief which is a class C felony here in Alabama.
He, or someone who just happens to sound like him and was in his house, called into a radio show and [I]admitted[/I] he poisoned the Toomer's Oaks.
