Lawyers for Apple have raised a last-minute challenge saying new evidence suggested that the two women named as plaintiffs may not have purchased iPod models covered by the lawsuit.

Lawyers representing both consumers and businesses claim that the restrictions meant Apple could inflate the prices of iPod in an anti-competitive manner. They are seeking $350m in damages, which could be tripled under US competition laws. But after lead plaintiff Marianna Rosen testified on Wednesday, Apple lawyers checked the serial number on her iPod Touch and found it was purchased in July 2009. The other main plaintiff, Melanie Wilson, also bought iPods outside the relevant timeframe, they indicated. "I am concerned that I don't have a plaintiff. That's a problem," Judge Yvonne Gonzalez Rogers said at the end of the trial's third day of testimony in Oakland, California.

The case has been rumbling on for years and offers a fascinating insight into the early days of the digital music business. At the start of the millennium, the big record labels were terrified that illegal copying of digital music could ruin their businesses.
**SOURCE**
Lawyer Bonny Sweeny said...
Uh-oh. Did swebonny's cover just get blown?
Anti competition? exactly what does that mean?
Apple could inflate the prices of iPod in an anti-competitive manner
but wouldn't they make LESS money because of getting massively less customers?
Anti competition? exactly what does that mean? but wouldn't they make LESS money because of getting massively less customers?
You're dealing with Mac Users. 80% of them are too stupid to search for the best deals so you can get away with selling your shit for crazy prices. They're like the modern version of Amiga users.

mac hardware is good quality just overpriced as shit
that or they are like Garry and have too much money to care anyways :v:
I can confirm this is the case. Also, like it or not, Apples products are functional as fuck, and idiot proof. Redeeming factors for people who don't have the time for tinkering with their shit anytime something breaks.
I'm having trouble understanding what any of this actually means and why exactly it matters, could someone give it a breakdown?

I used to "roll-my-own" solutions when I was in High School and had time to tinker, but it isn't really like that for me anymore. I'd rather buy the turnkey solution and stop worrying.
people who say that apple makes shit products are wrong, they make pretty good products marked up a couple hundred percent
mac hardware is good quality just overpriced as shit
mind showing us how it's overpriced (not referring to anything before 2012) [editline]6th December 2014[/editline]
people who say that apple makes shit products are wrong, they make pretty good products marked up a couple hundred percent
same markups as practically every other manufacturer excluding accessories perhaps
mac hardware is good quality just overpriced as shit
In recent years, apple has become a lot more fair in their pricing. Look at their 5K iMac, the whole unit comes at a price not much different than a 4K monitor equal to it's size. Some things are still overpriced, but it's definitely getting better.
people who say that apple makes shit products are wrong, they make pretty good products marked up a couple hundred percent
It's the same principle as overrated TV shows. Often they're definitely good shows, but the obsession around them leads some people to claim they were never good in the first place.
I'm having trouble understanding what any of this actually means and why exactly it matters, could someone give it a breakdown?
As I understand it, Apple published their own DRM scheme for music, which they sold through iTunes in addition to supporting DRM-free music. Some companies basically reverse-engineered the DRM and applied it to their own music, fooling the OS into thinking it was Apple-licensed, opening up some pretty glaring security holes in the software. Apple rolled out a patch to fix the problem, which reverted the devices to factory settings, in the process deleting the offending files. The plaintiffs alleged that it was an anti-competitive measure, but are probably going to lose, the latest turn being that it seems that the filing plaintiffs didn't actually buy their devices during the timeframe relevant to the lawsuit.
people who say that apple makes shit products are wrong, they make pretty good products marked up a couple hundred percent
idk about you, but i had a lot of bad experiences with apple stuff(Two of my ipod nano buttons broke down in less than 1 year for instance). i'll admit their software is pretty streamlined though.
mind showing us how it's overpriced (not referring to anything before 2012)
Seriously? As said before apple has gotten better in their pricing, but you're still paying a huge chunk of change just for the name seemingly. Look at a new imac, they're about 1,200 or so. I could still build a pc, including everything from the case to a monitor and still build a better machine for less than 1,000 dollars. If i want to get a fantastic display i could easily choose a lesser processor which would be on par with whats in an imac, and use the funds for a top notch IPS display and still be getting a machine that rivals an imac for less money.
Anti competition? exactly what does that mean? but wouldn't they make LESS money because of getting massively less customers?
Are you stupid? Do the two words Anti and Competitive not compute in that giveaway pocket calculator brain? Apple (read: Steve Jobs) was so dead set on being god of all music on earth that they actively, knowingly, and intentionally denied non iTunes (ripofftunes) music on iPods because Apple felt it owned half the fucking planet. They thought they could control the entire music industry and profit from the top of their Pharoah pyramid. Now they are getting FUCKED for anti competitive practices. Apple hasn't made a single penny on an original idea since Jobs died. Cook has murderer and gutted the company. Long live Droid.

Wouldn't that hurt them due to the fact that there are an insane number of alternatives that would be cheaper? higher prices of ipods means less customers. Is this not known?
mind showing us how it's overpriced (not referring to anything before 2012) [editline]6th December 2014[/editline] same markups as practically every other manufacturer excluding accessories perhaps
It's still a bit higher, but as I look at other prices for similar quality hardware it isn't nearly as much as it used to be. And Jesus, it's been a while since I've looked at any computer prices. New laptops and prebuilt desktops of decent quality are so damn expensive...
In recent years, apple has become a lot more fair in their pricing.
It's the same principle as overrated TV shows. Often they're definitely good shows, but the obsession around them leads some people to claim they were never good in the first place.
People don't understand that overrated does not necessarily mean bad.
I can confirm this is the case. Also, like it or not, Apples products are functional as fuck, and idiot proof. Redeeming factors for people who don't have the time for tinkering with their shit anytime something breaks.
functional as fuck... idk which way that even goes, but as far as functional goes, they've had a longer time to perfect the systems menu than android yet they've inexplicably gone more convoluted and harder to use, to the point where anytime i have to fix something on one of my family's i-devices i have to break out an online instruction manual they do have different ideas about what should be readily accessable from opening the menu but still stuff like wifi status and screen brightness should be the easiest things to change but you have to dig around their menues to get to them [editline]7th December 2014[/editline] apple's continuing problem and also their edge is that they tend to push tech to market a little before everybody else does. it has paid off with the ipad but in things like the retna displays, it only makes their hardware much more expensive for very little tangible benefits, and then in the case of their saphire displays it can completely backfire and cost them.
they do have different ideas about what should be readily accessable from opening the menu but still stuff like wifi status and screen brightness should be the easiest things to change but you have to dig around their menues to get to them
Both of those things are at equal submenu depths in both the Android and iOS Settings apps. Actually, the brightness slider requires one less tap to access on iOS so I don't know what you're talking about, it sounds like you just only have experience with one platform.
In recent years, apple has become a lot more fair in their pricing. I don't think you're the best judge of pricing fairness.
Didn't you buy a $2,500 Mac laptop that was about as powerful as a $1,000 laptop despite people giving you far more powerful and cheaper alternatives? I don't think you're the best judge of pricing fairness.
I don't see how that's possible because any MacBook in that price range is going to have an i7 which means the performance is completely gated by what SKUs Intel offers, and there's no way for there to be more powerful alternatives because Apple always offers a SKU with Intel's fastest mobile i7. Just for the record, you cannot buy a Windows laptop that is as good as the 15" Retina MacBook for less money, and in fact you can not buy one that is as good at all because no Windows OEMs calibrate their displays so they're completely worthless for any color sensitive work that professionals will be doing. So you'll just have to pile on $1500 for an i1 Pro 2 to fix the display on whatever Windows laptop you buy, at which point it's not going to be very affordable. This is why I bought a rMBP and not an XPS 15 QHD+.
they do have different ideas about what should be readily accessable from opening the menu but still stuff like wifi status and screen brightness should be the easiest things to change but you have to dig around their menues to get to them
Since iOS 7 they've had a "control center" that can be accessed by swiping up from the bottom of the screen. The Control Center includes easy-access settings, like airplane mode, turning wifi or bluetooth on/off, locking the screen orientation, adjusting screen brightness, music and volume controls, airdrop (instant file transfer), as well as a flashlight, timer, calculator, and camera. They're all accessible with one swipe up, and they have been for a while now. [t]http://km.support.apple.com/library/content/dam/edam/applecare/images/en_US/iphone/iphone5s/control_center.png[/t]
And all this was directly ripped out of Android, yet android is the badguy in the lawsuits.
how's that directly ripped from android in any shape or form you could say android ripped off everything from webos if you want to keep using those ridiculous pulling-at-straws complaints
how's that directly ripped from android in any shape or form you could say android ripped off everything from webos if you want to keep using those ridiculous pulling-at-straws complaints
webOS was the best mobile OS, it's feature set was great, the only thing that ruined it was really shitty hardware.
