Obama, noting that some in Iran also want no part of any deal, said: "I think it's somewhat ironic that some members of Congress want to make common cause with the hardliners in Iran. It's an unusual coalition."[/QUOTE]

eh the clear political advantage asside, the NV government had nothing really to gain by any peace deal with the south at that point, it wasn't really till nixon went all rolling thunder on them that they were brought to the table

This is the text of the much cited Logan Act. According to supreme court precedent (United States v. Curtiss-Wright Export Corp, 1936), the president is the undisputed chief diplomat of the US government. There's really no question that the 47 signatories have violated federal law here, but the real question is whether any action will be taken. The historical record shows that the Logan Act is pretty much never enforced, but I don't think there's ever been a case this egregious before.

Politicians always have a loophole somewhere... no way any of them would ever be prosecuted ever.
Fuckin' hell. I really hope this Logan Act gets put into action here, I really don't want them to torpedo the one positive development towards peace in that region. Not to mention it'd be a fantastic example to finally put the GOP in their place, seems to me like they just keep crossing the line and always get away with it.

Accusing 47 senators (nearly half the entire Senate, and virtually all the Republican senators) of treason is not to be taken lightly, even with something as blatant as this.

Ok, this is almost exactly what Nixon did with South Vietnam and Johnson. Johnson was nearing an actual resolution. To the Vietnam war, and Nixon went through back channels to contact the South Vietnamese government and told them that if they refused the agreement and held out until after the election, that he would give them a better deal, and then the talks fell apart. Nixon sabotaged peace talks in Vietnam to win an election and I echo Johnson's sentiments, its akin to damned treason.
