Under terms of his plea agreement, Anthony Garcia admitted he tainted a sample of the yogurt he was handing out at Sunflower Market in January. He also admitted putting some of his semen on a plastic spoon that he placed with the yogurt. Garcia then approached a female customer and offered her a sample. "The criminal conduct to which Anthony Garcia pleaded guilty today is completely outrageous," U.S. Attorney Kenneth J. Gonzales said after Garcia's appearance in federal court. "No one should have to endure this type of experience simply because she or he accepts a food sample while shopping for groceries." Garcia, 32, pleaded guilty to charges of adulterating food and making false statements to federal investigators. The woman told police that after tasting the sample, she spit on the floor several times and wiped her mouth on the garment she was wearing to get the taste out of her mouth. Investigators collected samples of the woman's spit from the floor and took the garment she was wearing as evidence. Police say Garcia was linked to the yogurt through DNA samples. Authorities said Garcia then lied to investigators about the case. In court documents, federal prosecutors called the allegations "sickening and appalling." Garcia faces up to three years of imprisonment to be followed by three years of supervised release. [/QUOTE] You're right it's not a good idea but getting STDs from oral is unlikely unless you have open mouth sores or internal cuts etc. That and I love how he managed to randomly chose probably the one person who'd hand them in for forensic testing etc, if it were me I'd just spit it out and say it's tasted crap, not assume it was semen.

Ok, that's pretty horrible, still, I think 3 years are harsh. Fine the living shit out of him, perhaps make him pay to the woman herself, possibly give him few weeks of obligatory community service, but unless he actually has some STD (which they should obviously check), he shouldn't go to jail. I mean, yeah, it's pretty nasty, but realize what we are talking about. 3 years in jail is quite some fucking time, plus it ruins his chances to get a real job. Also consider how much will his inprisonment cost. Tens of thousands of dolars out of tax money wasted for a disgusting but most probably harmless idiocy. He should get punished, but unless the woman actually gets some desease, no serious damage was done, and he shouldn't go to jail.

Quite a few will be shaved off for good behavior and a bunch of other bullshit. Probably a year at most in jail.

Not to say that extensive jail time is OK because no one is universally innocent, but there's probably a lot of psychological desensitization that has happened for someone to willingly give their cum away in yogurt samples.

Three years is a very long time to spend in a cell, especially for something trivial like this. He didn't murder anyone, he just did something incredibly disgusting. So disgusting that he should be forced to throw away three years of his life? Does that not seem excessive to anyone? And why are you all so quick to assume that he has mental problems, could you not imagine a sane person doing this? What he did was gross and wrong but was it really that terrible that he deserves this degree of punishment, I don't think so.

Even if you make therapy mandatory, that doesn't necessarily mean they're going to accept it. And besides, a shrink isn't a quick fix. Sometimes it takes years to help someone reach a healthy mental state.

He can get feedback to the court, and in case the patient doesn't try to get better, THEN he gets sent to slammer.
