Well, at least without being compensated handsomely if you’re terminated and that’s the primary reason for being handed your pink slip. A former insurance manager in Australia recently sued his former employer for doing just that, and a commission ruled in his favor.
This case involved more than just a casually-downloaded image or two or an inopportunely-timed stream that a co-worker just happened to see. This guy reportedly downloaded scads of porn on his phone and laptop, both of which were provided by his employer. He even stashed some original homemade content on there, and didn’t deny as much when questioned about it.[/quote]

TBH the only problem I really see with him doing this on a work paptop outside of working hours is the potential security risks it leads you open to.

This was all done entirely outside of working hours, I can absolutely 100% see why the court rules in his favour.
Company should've made him sign an acceptable usage policy. We do this for every new hire and they don't get their kit until it's signed.
I'm surprised he got fired straight away though. If it did happen at our place they'd probably get a disciplinary rather than straight-up getting fired, depending on prior behaviour.
I'm assuming he didn't sign anything that said what the laptop would be used for but I can see why they'd fire him if he had signed it. I can imagine them firing him for using the work laptop to constantly check Facebook or Reddit if their policy explicitly stated that it's for work only
This just feels stupid, but that's coming from an American, I guess... the lack of at-will employment abroad confuses me greatly.

This is probably why we won the case. The company kind of threw both those out the window here.

Unfortunately, that's a risk the company's willing to take by letting employees work anywhere with laptops. That and the whole "BYOD" trend is making it more difficult for IT to keep companies safe.
I can imagine the ruling; "We all have urgent, sudden urges from time to time!"
All my employer said was to not use all the data and don't break it. Although one employee did have a dick pic on his phone and they laughed and deleted it, no harm really.

Well downloading it, assuming from free places, is still one of the porn bastions for viruses.
This is why you have an acceptable use policy for company equipment. I bet this company will never make that mistake again.
Always have a second computer for personal shit. I would never come close to risking my job over some porn. Hell, you could probably just use your phone now-a-days.

Not everyone has one, though if you're going to be downloading shittons of porn you should probably get one. My old boss owned no computer type device. Company laptop, phone, car.
