Samsung bypasses Apple's ban on the Galaxy Nexus by shipping it pre-loaded with Jelly Bean

Puke flavor...part of me wonders why they made those Harry Potter Jellybeans, I mean it was cool but you couldn't eat a bunch of them, and really the only good ones were cinammon and uh...that's it.

I went and got my new Galaxy Nexus at the store Monday - absolutely no problems buying it, but I think my phone has a hardware failure with its signal, so I might have to get it replaced, or just get myself the S-III.
I haven't heard any store in my area actively trying to stop sales of the Nexus in my area, so how widespread is this sales ban?
