Kansas court says sperm donor must pay child support
(CNN) -- A Kansas sperm donor caught in the middle of a child support case says he wanted to help a lesbian couple when he made the donation nearly five years ago.
[...]
This story begins on Craigslist in March 2009. That was when Marotta noticed an advertisement from the Topeka couple, seeking donated sperm.
"Intrigued" by the ad, he says, he delivered three cupfuls of his sperm -- gratis -- to the women.
fucking incredible
three cups of cum

And suddenly Kansas sperm banks have absolutely no donors...
A Kansas sperm donor caught in the middle of a child support case says he wanted to help a lesbian couple when he made the donation nearly five years ago.
Instead, he may end up paying for his action.
A judge ruled that William Marotta must pay child support, even though he says he signed documents waiving his parental rights.
thats pretty dumb
So basically the two women broke up, one of them was ill so she asked for state aid and it's the STATE that wants him to pay child support.
that's hella dumb

It wasn't an official thing, it was a craigslist ad.
It's stupid, but really this is why you don't do it though craigslist.

Unless he managed to present the document, it probably doesn't mean much, as the judge could probably quite rightly think he was making shit up (though I doubt he was)
It wasn't through official channels, it's not going to get over turned.
this, the sperm donor fucked up
Erp, nvm wasn't an official sperm bank
This is one of those cases where the spirit of the law is obviously different than the letter of the law. There's no moral argument to be made for forcing him to pay child support.
If judges don't consider the spirit, then we have no use for judges. There might as well be computer systems.
And this is why I don't just go around jizzing in a cup for any random person on craigslist. No matter what they want to pay me.
The document doesn't contain the needed legal language to absolve him of responsibility.
You can waive your parental rights, but you're not going to get to waive your parental responsibilities. (i'm not saying he deserves it, but he should have known better and the couple should have gone through REAL channels, not bullshit ads.)
Not everyone can afford the exorbitant fees associated with going through those 'real' channels, though.

Yeah, I'd have sympathy for this guy IF he had followed the already established procedures for doing this kind of thing and then he got stuck with the bill. That would be wrong.
But he went outside the system, and therefore outside any legal protection he might have had, that's his choice and now he pays for it.
I know, I know, who doesn't want to take cups of semen to lesbians? It's hard to think of the legalities while you're squeezing out a few more CCs of semen, that cup isn't going to fill itself you know. I'm sure he told the judge "Don't blame me for what they did with that semen, it's out of my hands" but rules are rules.

But they can afford a child?
If someone sneaks into my room five minutes after I go to sleep, steals a sticky sock and impregnates someone, will I have to pay child support for that kid?
I think that you should have to actually have sex with someone to be legally the parent of the child, unless you agreed to be their parent beforehand.
Haha holy shit, this almost reads like a The Onion article, that's truly unbelievable that the judge isn't getting reprimanded and barred from law for something like this.
This is fucking nuts, anyone helping out any couples that can't afford sperm banks in Kansas after this would have to have some serious balls.

The child will have your DNA and the only thing you'll have is your story, which consists of "I didn't have sex with her". Sounds like an easy loss to me.
Jesus that's a terrifying thought. Are we really at a point where guys less than 20 years old will have to consider getting operations to prevent pregnancy? This is insanity.

Or just not do shady deals on Craigslist.

Really, I'm surprised at how many people are overlooking the level of stupidity it took for this guy to get himself into this situation.
Keep in mind the system is geared to provide for the CHILD. The priority is not to protect the father's interest or the mother's but the child's interest. In a case like this, they look to the moms(both of them). If they can't pay, then they look to the father, if known. As a last resort, the state, ie the taxpayers, pay in the form of welfare/etc.
This guy, if he followed state law, could have been exempted from responsibility. Neither he nor the moms were thinking about anything than their own selfish interests though. He just wanted to see some lesbians and deliver some semen, no strings attached. I can say that because by his own admission that's exactly what he did. They just wanted a kid even though they could not afford to provide for one, proven by their Craigslist scheme and subsequent lack of financial security.
Losers, all of them. But somehow the law and judge are the dumb ones? I don't think so.
Is it legal to sell your sperm like they do it for horses, bulls, pigs, etc... ?
this baby is going to be fucked in the head man

Laws actually pretty fucked sometimes. A 15 year old was raped by an older women and had to pay Child support when she decided to have the child. Not to mention the infamous case of that guy in a coma paying child support to a nurse who used his stolen semen.
I should donate sperm. I want some children without the responsibilities.
Shawnee County District Court Judge Mary Mattivi said on Wednesday that Marotta failed to conform to Kansas law, which says a licensed physician must be involved in an artificial insemination process, court documents show.
Basically, the guy responded to an ad online, did not go to a sperm bank, and now the state is looking for someone to pay out on child support, and considering Kansas does not permit, the biological father is the one that must pay.
Don't get the criticism towards the judge, sperm banks, or the laws, the ignorance of the donor is to blame for this snafu.

Do you have those sources, no way could this shit actually happen.

The state has some pretty backwards laws. He's considered the father because of the state not recognizing same-sex marriage. This could all have been simplified and harmless if this wasn't the case. Even than, I don't even see why 2 females can be considered guardians without being married.

This was is one of the cases mentioned but apparently theres quite a bit more like it.
this, the sperm donor fucked up
Gotta be honest here, if you want to donate sperm, there's official ways to do it. Of course they always want to put their hands in your pockets one way or another so I could see why someone would want to go around it, but then if something goes tits up, this is what can happen
I feel bad for the dude and it's bullshit, but for some things you should always go the right, legal way to avoid stuff like this
