A 17-year-old is on trial in California accused of shooting dead his classmate because the boy was gay.
Accused Brandon McInerney (left), and victim Larry King (right)
The crime took place three years ago in 2008 when 14-year-old Brandon McInerney shot his then 15-year-old classmate, Larry King, twice in the back of the head.
The prosecution claims McInerney is a "white supremacist" and the killing of his classmate in an Oxnard school was because the dead boy's sexuality was against his ideology.
The defendant, however, says that was not the case, and he shot Larry King because of his unwanted advances.
McInerney does not deny the killing but argues that the crime was voluntary manslaughter, not murder.
Some of you may remember this story, what an awful and unneeded death.
oh well jeez he was gay, its alright Brandon McInerney you're off the hook.
I guess Larry King

wasn't live.
This seems like an open-and-shut case but the American legal system always finds a way to surprise me.
Brandon's a cunt, poor little Larry.
...Go to hell you nutter.

I'm suspending your ability to post
and he shot Larry King because of his unwanted advances.
Is that all the defense can come up with?
It's sad to see that someone is hated because of their sexuality, it's amazing how you'd think something like this would be stopped.
Remember kids, it's bad to kill somebody but it's fine once you find something about them that's abnormal.
If you shoot someone in the head, I'm pretty sure you intend to kill them. How does this qualify as manslaughter?
Wasn't surprising.
voluntary manslaughter
AKA Murder you dumb motherfuckers.
If you shoot someone in the head, I'm pretty sure you intend to kill them. How does this qualify as manslaughter?
Exactly. Guns are not designed to maim or warn.
AKA Murder you dumb motherfuckers.
It's not though. Murder carries a higher sentence than Manslaughter, regardless of whether it's voluntary or involuntary.
It's not though. Murder carries a higher sentence than Manslaughter, regardless of whether it's voluntary or involuntary.
Manslaughter is an involuntary killing per say. This is murder, stop being stupid.
Manslaughter is an involuntary killing per say. This is murder, stop being stupid.
Voluntary Manslaughter is where someone is provoked into killing someone, and it is considered reasonable that someone would be provoked in that situation. If whatever was provoking them isn't considered reasonable, then it's considered murder.
For example:
You come home, and find your father has beaten the shit out your mother. You go into a rage, and attack him with a knife with the intent to kill him, and do so - Voluntary Manslaughter.
You come home, and find your brother has taken one of your beers. You go into a rage, and attack him with a knife with the intent to kill him, and do so - Murder
Manslaughter is an involuntary killing per say. This is murder, stop being stupid.
Not really.
Either way, the sentence won't fit the crime. Not under this legal system.

you're trying to make light of a situation that is not funny in any conceivable way and you should be ashamed of yourself for having no self-control.
how the fuck is this manslaughter he fucking shot him twice in the head

Shot twice in the head for being gay, either way this was murder.
By the logic of this pile of septic filth; if you said a bad pickup line to someone regardless of gender and they didn't appreciate it, they may kill you as voluntary manslaughter.
how the fuck is this manslaughter he fucking shot him twice in the head
Because apparently the poor kid who got killed provoked the guy with a gun 'with his unwanted advances.' Personally, I think that's bullshit and is trying to play into the whole myth of gay people wanting to fuck every man in sight. It's also fucking retarded because on that basis if someone hit on a girl who didn't like it and she killed them, that would be manslaughter, not murder as well.

I agree, but the law doesn't see things in such a way.
Try him as an adult. Hope he enjoys prison.
Idiot.
It's just the defendant's lawyer arguing for manslaughter. The prosecution says it's murder and a hate crime.

There. Just for the sake of having a source, and knowing that it isn't something the op just made up for some reason.
While prosecutors argue the shooting was a straightforward hate crime, the defendant says he carried out the shooting "out of passion".
The defence dismissed the accusations of links to the white supremacy movement, saying Nazi literature he was found to have was connected with a school project.
Defence lawyer Scott Wippert told a Los Angeles courtroom that his client had reached emotional breaking point over King's advances.
"He did this out of heat of passion," the lawyer said. "These were two troubled young men and this was a tragedy."
But prosecutor Maeve Fox said that was not the case.
"The evidence in this case will prove to you that this killing was an execution," she told the jury.
The defendant is being tried as an adult and faces life imprisonment if found guilty.
If you reach a 'breaking point' from someone's advances, you tell them to stop.
If it keeps happening, you tell a teacher. (If you're a student)
And eventually the police, if they don't stop.
You don't go straight to shooting them.
the defendant says he carried out the shooting "out of passion".
I can only assume this was premeditated unless he always carried a gun on him.
Which begs a load of questions if he did.

That and the fact it was in the back of head. If you're in a furious rage, you don't wait for someone to turn around or walk away.
