A U.S. district judge has overturned Michigan’s bans on gay marriage and same-sex adoption.
In his 31-page written opinion released Friday, Judge Bernard Friedman said the constitutional amendment known as the Michigan Marriage Act, passed by the voters in 2004 was unconstitutional because it denied gays and lesbians equal protection of the law.
Minutes after the judge's opinion was released, Michigan Attorney Bill Schuette, a plaintiff in the case, announced he had filed an emergency request for a stay and appeal of the judge's ruling with U.S. Sixth Circuit Court of Appeals. If the stay is granted, the status quo remains in Michigan and both same-sex marriage and adoption are not legal.
"Voters enshrined decision in our Michigan constitution and their will should stand and be respected. I'll continue my duty to protect, defend Constitution," Schuette said.
The ruling by Friedman stems from a lawsuit filed by Hazel Park nurses April DeBoer, 42, and Jayne Rowse, 49, who are living as a couple, raising three special-needs children they adopted as individuals.
Their lawsuit challenged the constitutionality of the laws banning gay marriage and adoption by same-sex couples.
Specifically, they challenged a 2004 constitutional amendment passed by Michigan voters that defines marriage as a legal union only between a man and a woman.
Someone tell this Schuette fucker about the supremacy clause in the federal Constitution. Actually,
Voters enshrined decision in our Michigan constitution and their will should stand and be respected. I'll continue my duty to protect, defend Constitution.
If this is a faithful quote reproducing exactly what he said, I think it says everything that needs to be said about the opponents of LGBT equality.
The federal Constitution supersedes state law. Plain and simple.
Oh great, now I have to protect my children from being adopted by gays when I'm at the mall?!
It's amazing how this movement has picked up speed in the last 24 months.
is there no end to the gays' reign of terror?
how am i expected to raise a child knowing there's gay people in the world?
I feel we should make a gay marriage bingo at this point.
good good
soon the Gay Ones shall rise
Oh god no, more children might be adopted and find a home.

After Utah and Oklahoma saw their gay marriage bans overturned in federal court in mid-January, I made a prediction on RationalWiki that four more US states would overturn bans or pass pro-gay marriage laws by the end of 2014.
This makes three. I was not expecting this to happen this fast.
Fucking dreadful. Illegal immigrant Obongo is yet again ruining American family values
Fucking dreadful. Illegal immigrant Obongo is yet again ruining American family values
Them good old God-fearing American family values that say you're better off with no parents than gay parents.
Canada legalized same-sex adoption in 1998, and as you no doubt have heard, after the Gay War of 2009, we have been living in a totalitarian hellhole where straight white Christians are being systematically rounded up and sent to logging camps in northern Ontario where they never return. The Queen has been dethroned and replaced with a lesbian dominatrix dictator who has rewritten the Bill of Rights to exclude white people and cis men of all races from fundamental rights.
Please invade us, America, and save us from ourselves. We did not know what we were doing when we allowed gays to have kids live in their snappily-furnished homes.
i can't stop praying right now
we're fucking doomed

This is just a lie, starting in 2001 all non-trans individuals are forced to undergo sex change operations to ensure that everyone is LGBT. There are no cis men. Do not mention them again.

remember me
Just you sinners wait till baby jesus comes back and smites all you gays and gay lovers back to babylon
The law was walking alone down a dark, damp alley that smelled of rain and moldy wood. It was suspicious of its surroundings. It knew what had been happening to others like it. Someone was out to get its kind. It walked briskly enough to bring droplets of water up with its steps. It couldn't wait to get out of the shithole corridor it was in. Just one more turn and--
A knife in the gut... through the stomach and into the spine.
Homosexuals who don't repent for their lifestyle are going to hell, said the state's final witness in the federal trial challenging the constitutionality of Michigan's bans on same-sex adoption and marriage..
The witness, Douglas Allen, is the author of a 2011 report, "More Heat Than Light: A Critical Assessment of the Gay Parenting Literature, 1995-2010." He also criticized a major 2010 study on gay parenting and households by Stanford sociologist Michael Rosenfeld who testified for the plaintiffs last week that children raised by gay parents had the same outcomes as children raised by straight parents.
Asked by plaintff's attorney Kenneth Mogill if he thought homesexuals[sic] were eternally damned, he responded:
"Not repentant? Yes."
Joy Yearout, spokeswoman for Michigan attorney general William Schuette, a defendant in the lawsuit, said the office is confident the state put on a good case to defend the Michigan constitution which bans gay marriage.
She said Allen made a good argument that the science that Rosenfeld based his resarch on isn’t settled and that Allen's personal and religious beliefs have had "no impact on his research and the results it reaches."
No wonder the judge ruled against these idiots. Also, William Schuette is, in fact, the Attorney-General of Michigan. The OP story merely identified him as "Attorney William Schuette".
The Attorney-General of Michigan doesn't understand the supremacy clause of the US Constitution.
Some of the counties here are still extremely red. A few towns I cross even have "Jesus Saves" and pro-life billboards peppered everywhere. I wonder how they'll react? More obnoxious adverts on the TV?
nice. you're next, gay abortions.

There's a semi-trailer near me that says "If you support the communist party, vote Obama" in red ink and clearly visible from the highway. (West Michigan)
So wait, does this mean gay marriage is legal here? Or does this just mean that it's most likely going to be overturned at some point soon?
Either way, I'm glad my state actually did something good for once. A friend of mine got really disturbed when laws here were just as bad as Arizona (our civil rights law doesn't include sexuality), so hopefully this'll calm his nerves.

Oh god my dad is such a homophobe; he's all "there's still hope" and "it's supposed to be the will of the people, man!". My heart goes out to all who were beneficially and neutrally affected by this!

Gay marriage is nominally legal there now, but your Attorney-General has filed an emergency stay to prevent the judge's decision from taking immediate effect while the appeals process happens. I don't know if the stay has been heard and decided yet.
Ask your dad if it's the will of the people to block the federal constitution from upholding equal protection under the law. Because that's what he's saying it is.

I've seen a similar trailer with large red lettering spelling, "Socialism and Communism = Poverty and Hunger." Also of West Michigan.

Many US politicians seem to mix up the US Constitution with "those few bits of bible passages and out-of-context rhetoric they did hear once upon a time".
Fuck. We had a vice presidential candidate in 2008 who thought that the Vice President had powers equal to or greater than the President. The only powers of the VP in the US are to be a tie-breaker in the Senate, and to step up if the President dies.
I always want to facepalm when I hear the anti-LGBT rights people say things that essentially boils down to:
"Them having the same rights I have infringes on my rights"

Yes yes sheesh we've all seen the sign on M-6.
I also await the conservative rage with popcorn.

It's like that first judge did it and a shit ton of other judges have been like "wait I can do that holy shit"
it's amazing
I never thought I'd live to say this, but it's a good day to be in Michigan.
Hold on just a second, Federal appeals court suspends same-sex marriages in Michigan until at least Wednesday.

This always happens if the judge doesn't hold back the changes (i.e. gay marriage being legal) until after the appeals process has had time to validate the decision: An opponent of gay marriage files a stay with the appeals court.
There is, in fact, a very good reason for this. If the judge's ruling is overturned on appeal, anyone who got gay married immediately after the judge declared it legal is then unintentionally in a fraudulent marriage. Given the huge amount of paperwork and formal changes that tend to occur with a marriage (combining medical benefits and tax returns, sharing bank accounts and property, etc.) this is potentially a giant clusterfuck in the making.
Utah's having to deal with a couple thousand Shrodinger's Marriages because they were slow on this. It's a real problem.
