Topekan William Marotta sought only to become a sperm donor — but now the state of Kansas is trying to have him declared a father.
Nearly four years ago, Marotta donated sperm in a plastic cup to a lesbian couple after responding to an ad they had placed on Craigslist.
Marotta and the women, Topekans Angela Bauer and Jennifer Schreiner, signed an agreement holding him harmless for support of the child, a daughter Schreiner bore after being artificially inseminated.
But the Kansas Department for Children and Families is now trying to have Marotta declared the 3-year-old girl’s father and forced to pay child support. The case is scheduled for a Jan. 8 hearing in Shawnee County District Court.
Hannah Schroller, the attorney defending Marotta, said the case has intriguing social and reproductive rights implications.
She said Marotta, a mechanic who has taken care of foster children with his wife, Kimberly, answered a Craigslist ad placed by Bauer and Schreiner seeking a sperm donor in March 2009.
In an email to Marotta that is part of court records, Bauer described herself and Schreiner as a “financially stable lesbian couple,” with Bauer working outside the home and Schreiner being a stay-at-home mom with their other children.

Saw this in the local newspaper today. tl;dr - Lesbian couple puts ad on Craigslist for sperm donor because family practitioner won't do it for them. Guy responds and donates sperm for free. Both parties agree that the donor won't help support the child. One of the parents becomes "significantly ill" and cannot work, the other stay-at-home-mom files for Medicaid, and is then denied because she wouldn't give the state the name of the man who donated sperm so the state could make him pay child support.
This seems kind of silly to make the guy pay for child support. Anyone could have sperm donated to them and they could artificially inseminate themselves in their own home, and then file for Medicaid or whatever and make the donor pay for child support, when they really should have nothing to do with the child.
Probably because a legal adoption hasn't taken place, which is probably because Kansas won't allow adoptions by same sex-couples. In the eyes of the law, the man is the father and the one that gave birth is the mother.

Isn't this why sperm banks don't keep records of donors beyond physical descriptions and redacted medical records?

For closed donors, yes. But Open donors (as in, those who have their full contact information listed) get paid substantially more. Where a closed donor could be paid $50, an open donor could be paid upwards of $300.
At the very least it's the emotionless government demanding it, and not a bitch who got pregnant.

Kansas is incredibly harsh to anyone who is not heterosexual. We have a lot of dislike and hatred towards homosexuality for some of the most ridiculous reasons I've ever heard here.

I understand what you mean, but I fail to see how this ties into the article when the lesbians are the ones getting money from a regular guy.
The title's a bit misleading, the Lesbian couple don't want the donor to pay child support, it's the state that wants to make him do it. All the couple want is to file for medicaid because the working person of the house is unable to work at the moment.

Because they were filing for finical assistance, which they've been told they can only get by making they guy pay them child support, rather than getting regular benefits from the government.
It's discriminatory to the couple because the government is ruling that they're not the kid's parents, the one that gave birth and the sperm donor are.

Why don't they just agree that he pays child support and then they give it back to him? Seems an easier way out than starting fights with the (admittedly stupid) state over this.

Shouldn't parents have a right to refuse child support anyways? Considering it's something you usually have to fight for when you actually want it.

I didn't say anything about the lesbian couple paying him. I simply said I would tell those women that getting sick was their problem.
