A former college football player has scored a court victory against Electronic Arts. EA used Rutgers College quarterback Ryan Hart's likeness in several versions of its popular NCAA Football sports game. Mr Hart sued seeking damages saying EA should have sought his permission before using his likeness in the game. A US court threw out his initial claim but that earlier decision has now been reversed on appeal.
SAUCE
Isn't it in Fifa where they don't have the license to make the German national team in the game, so they have them in it, but with weird parody names?
I think that's ProEvo soccer.
I think that's ProEvo soccer.
No, it's either FIFA or Football Manager, that's the only ones I've played, and I clearly remember laughing my ass off at some of the names.
Isn't it in Fifa where they don't have the license to make the German national team in the game, so they have them in it, but with weird parody names?
Nah, PES does that a lot since it doesn't have crapload of licences (and one of them being Bundesliga). It's either PES or FM.
PES base game generally has stupid names due to licencing, it's the only thing bringing it down - if it had the full teams with the right names I'd play it over FIFA any day For example, Liverpool are the Merseyside Reds and Chelsea are the London Blues

Which was quite embarrasing, as the Netherlands were the World Championship runner-ups at that moment!

FM just doesn't have the german national team. EA Sports is based in germany and owns the license and exclusivity to it's national team so no other football game can use it.
What the fuck kind of damages can you get by being in a sports game?
What the fuck kind of damages can you get by being in a sports game?
severe emotional damage and trauma that can only be fixed by lots of money
I seriously can't understand why this is getting winners. Its basically just "boohoo someone in a video game looked like me,I'm seeking payment for all the time some loser played as me and lost"

You can be damn sure if someone used Riccitiello or whoever is their new CEO in a game and a sold it they'd be jumping all over that. Plus nobody seems to like EA anymore.
I seriously can't understand why this is getting winners. Its basically just "boohoo someone in a video game looked like me,I'm seeking payment for all the time some loser played as me and lost"
it's like licensing a car in a videogame, same deal

Its basically just "boohoo someone in a video game looked like me,I'm seeking payment for all the time some loser played as me and lost"
The NCAA has a rule on the books that a scholarship athlete can't profit from basically anything they do whether it is related to the sport they play or not. So an NFL player is compensated for being in Madden, but the NCAA gets to cash the license check for all the players in the NCAA sports games. A former basketball player (Ed O'Bannon from UCLA) is challenging that rule in front of the supreme court IIRC, as it basically amounts to indentured servitude.
so does this mean that the football guys who aren't getting paid for having their faces in games are going to start getting checks in the mail, or is it just going to be this one guy?
I remember that it was the case with the Dutch national team. Which was quite embarrasing, as the Netherlands were the World Championship runner-ups at that moment!
But they didn't win.
IIRC this lawsuit wasn't alone. I think there's a class action lawsuit going on about the use of likenesses in NCAA, since it has something to do with the legality of using their images due to some odd technicality.

-snip-
Here's to EA finally getting their asses handed to them! (Of course, I won't expect them to prevent future mistakes from happening)
