[release]A TELEMARKETER has been penalised $A120,000 ($US126,536, €89,381) for making marketing calls to numbers on the Do Not Call Register in a landmark case.
In the first court penalty of its kind in Australia, the Federal Court found that Queensland-based FHT Travel and its director, Yvonne Earnshaw, breached the Do Not Call Register Act.
It found more than 12,000 marketing calls - spruiking a card that offered discounted flights, accommodation and cruises - were made to people who had placed their phone numbers on the register.
Ms Earnshaw was found to be "knowingly concerned in the making of a telemarketing call to a number on the register", but no financial penalty was imposed on her personally.
And the industry watchdog, the Australian Communications and Media Authority, has put all telemarketers on notice over calls to blacklisted numbers.
"This case and the penalty imposed should remind telemarketers of the serious consequences of breaching the Do Not Call Register Act," chairman Chris Chapman said.
"Telemarketers must respect the choice of people who have opted out of receiving their calls."
The court case followed 121 complaints about the FHT Travel calls made within nine months in 2008.
The watchdog issued FHT Travel with a warning, but complaints continued.
An investigation into the company's call records identified 12,507 telemarketing calls on the register.
Most calls were made to eastern Australian states, with 70 per cent to Queensland numbers.
The court action was launched after FHT Travel failed to pay an initial infringement notice of $48,400.
[B]The Do Not Call Register[/B]
The Do Not Call Register Act generally prohibits the calling of registered numbers for marketing purposes.
Since the Do Not Call Register commenced in May 2007, the ACMA’s investigations have resulted in payment of nine infringement notices to the value of $438,300.
In addition, 18 undertakings, enforceable in the Federal Court, have been accepted, and the ACMA has issued 10 formal warnings.
People can opt out of unsolicited telemarketing calls and marketing faxes by calling 1300 792 958 or by visiting [url]www.donotcall.gov.au[/url].[/release]

I'm not sure whats up with the maths, but 120000$ dollars divided by 12000 calls = 10$ a call, not a 1000$

I don't know why only 121 of the calls seemed to matter, but that's where the number comes from.
I hate those automated "robots" that call you, because I can't yell at them or tell them I'm on the Do Not Call list.
I prefer humans because that way you can yell at them, or put the receiver by your dick and fap into the phone.

I think in the USA if a telemarketing agency calls you and you're on the DNC list, you can sue them for an unspecified amount.

In the US most telemarkets use the DNC list as a "Call these phone numbers" list.

I hate it when it rings and I have to go answer it and it turns out to be a telemarketer. I swiftly hop on my penny farthing and cycle down to the operator room to tell them not to connect such plebs in future.
I enjoy misleading my local telemarketer.
Once i told him to call my "friend" who lives Afghanistan ( i told the area code ) who is interested.
