• Aliens Colonial Marines Class Action Lawsuit: Work-In-Progress or False Advertising

As I'm sure most of you have probably heard, Gearbox Software and SEGA have had a class action lawsuit filed against them for alleged false advertising of Aliens: Colonial Marines leading up to the game's launch. claiming that the early footage was 'work in progress' and not blatantly staged is another kick in the dick to all the people who bought the game. get fucked gearbox.
The footage that they provided as a means to sell the game based on looks was very clearly made to mislead the consumer on the amount progress and the overall graphical fidelity of the game as a whole. Most obviously false advertizing. The fact that they have been able to get away with it as they have is downright sad. Even if this lawsuit does go through, it will most likely end up with the companies playing the blame game so that they can look like the good guy in this whole situation.
Its hard to say really, I mean if you go 100% by the law, Gearbox / Sega will win the case. But in a moral choice, they kind of did falsely advertise the game. Its up to the court really.
I'd say because the footage was highly publicized it can't have been intended as a work in progress. Devs posting screens or videos on forums or blogs is one thing, every gaming news outlet putting it up on display with their blessing is another. The ACM that was shown was a polished luxury car with fine leather seats, the game we got was dull beater covered in cheap vinyl. If your game can't stand on it's own two feet, best rethink what you're doing.
They used the money that was supposed to be for Aliens: CM for Borderlands instead, and they moved people who were supposed to be working on Aliens: CM to work on Borderlands. So Gearbox Software and Randy Pitchford especially can get fucked for all I care, lying pricks.

Sega was a victim of gearbox as well in my opinion
I stopped trusting gearbox after Duke Nukem Forever Gearbox is very good to hype their games with false adverts etc and then the game turns into total shit. good game, shitbox

As much as I loved Borderlands 2. I would've much preferred a better A:CM game. Like, I've been waiting for it since it was announced YEARS ago.
Even if I don't agree with something as drastic as a law-suit, I think it's high-time that publishers are put in their place. We're fed a fair bit of crap; whether or not it's false advertising or not is debatable, but one thing is for sure, a lot of people are being disappointed by such persistent failures to sell products in a decent way. I'm all for a class-action suit. This is a good step towards clearing out the bullshit.
Gearbox can go eat a dick, they fucked this one over for sure, and I just dislike Gearbox as a company, the only thing they seem to have going for them is Borderlands, and that wouldn't be anywhere near as popular as it was if they had just turned it into a simple shooter.
Personally think the only good game they did was Opposing Force, didn't like BL1 that much. Oh, 66% off BL2 on Steam? Fuck you assholes, i'm not supporting a company that blatantly misleads consumers. Wouldn't have minded if they did it to EA or Activision (still unethical, mind you), but the publisher of my beloved Total War series? This shit better not affect Rome 2.
