• Duke Nukem Dust-Up: Gearbox vs Gobeille

Anyone notice that Duke Nukem 3D: Megaton Edition got pulled from Steam a while back? Maybe not but here is the news article regarding that episode: http://techraptor.net/content/duke-nukem-3d-megaton-edition-removed-from-stores But Gearbox is still up to their usual ways and bulling around others:
Richard Gobeille is an independent games developer. Disabled and with a wife currently hospitalized by lupus, Gobeille relies on royalties from his games for a substantial portion of his family’s overall income. Recently that took a hit, when Gearbox ended its distribution relationship with publisher Devolver Digital and Duke Nukem 3D: Megaton Edition was pulled from Steam. More than a month of Gobeille’s outstanding royalties, for use of his code in Megaton, were allegedly handed over to Gearbox in the process. All of which would be perfectly legal, if Gobeille’s games were infringing upon Gearbox’s rights. Yet Gobeille has a licensing contract in hand, signed by 3D Realms’ Scott Miller, saying the opposite. Gearbox CEO Randy Pitchford has since claimed that Gobeille was “hoodwinked by those guys… [w]e are both victims of the same culprit.” His position, as well as that of various other Gearbox representatives who’ve contacted Gobeille on the matter, is that Miller was never in any position of authority to cut such a contract. One even said “If you still believe his deal with you is valid then Gearbox can take that up with Scott Miller.”
Sources: http://techraptor.net/content/duke-nukem-dust-up-gearbox-vs-gobeille https://forums.duke4.net/topic/8340-the-duke-nukem-forum-on-gearbox/page__view__findpost__p__242839
The gearbox tweets in the techraptor article make me sick. How slimy can you get, "the license we gave you isn't real" "wahh stop harming and disparaging me" "send us an email and we will work on a story" then they completely ignore the email address.

Despite originally being in the clear, Gearbox turned around somewhat-recently and tried to aggressively bully him into compliance to shut the project down, threatening of court order behind the scenes, repeatedly going out of their way to bother him and then getting all quiet and shifty for long periods of time when he was ready to pursue counteraction with the proper accord. Gearbox is nothing but a bunch of pundits and jerkoffs over the Duke license.

[editline]28th April 2016[/editline] This is interesting:
“You helped us understand our source code options and actually locate them, which we were having a lot of trouble doing. It’s possible that you could help us again during development too. You’re one of the most knowledgeable people about Duke and you care about it. You should get to impact the new episode and weigh in on our engine updates.“
New episode and engine updates. Huh.
Borderlands not making enough shekels for you, Randy?
Randy is a pathetic excuse of a person, he's still defending alien cm for Pete sake! [editline]28th April 2016[/editline] If it wasn't for borderlands gearbox would of dug it's grave years ago
Another thing worth to mention is that they also pulled off the Duke Nukem forum category from their page, according to Duke4.net
I miss the old days of 3D Realms. Many great LAN parties were had from their games.
I hope Duke Nukem: Manhattan Project gets put back on steam. I was waiting to buy it, but it was taken down before I could.
I love gearbox for what they did with Halo PC. But they can eat shit for both this, and shutting down the duke3D alpha and beta releases.
It's like they want to give me even MORE reasons to not buy a Gearbox product ever again.

Kinda funny how many boxes I racked up saying Pitchford was a genuine sociopath. Guess people are finally catching up.

He is like a snake, I couldn't trust him, although I will give them a little props for the Homeworld remake...
New info on the Gearbox episode:
Unfortunately, the new lines from JSJ aren't that great. I don't think that's JSJ's fault. They're very deadpan. I don't think he was given any direction when recording them. No amount of post-processing is going to make it sound like he gave a shit. A lot of them are dumb lines ripped directly from currently popular media. I about cried when I heard him say "bazinga".
I'd post the Simpsons video of the kid screaming "Stop, stop! He's already dead!" But I'm not in the mood to get banned. Also, the port is incompatible with just about every CON mod ever apparently. Just let Duke die already ffs. He doesn't deserve this.
was Duke Nukem Forever really that bad of a game ?
was Duke Nukem Forever really that bad of a game ?
Strictly speaking, in terms of actual quality, it's not like, Sonic '06, Daikatana, Drake of the 99 Dragons or Superman 64. It works, it's functional, it's playable and completable without losing your sanity. But it's a tremendous bore of a game that is written as "duke is a super fucking awesome narcissistic bastard, gets all the bitches, and the only person that hates him is an alien sympathizer", has pretty much nothing but its black comedy from 2008 and raunchy out-of-date humor to stand out since the gameplay is bland as hell, and makes you wonder who thought the game was a good idea at all in its finished state. The DLC campaign, The Doctor Who Cloned Me, is apparently a lot better than the base game, but still. All Gearbox did was acquire the game, fix it up a bit so it was playable (which is probably why [sp]the final boss is just a harder version of the tutorial boss[/sp]), and push it out. At least they patched in being able to use four weapons instead of two, but still. After that, though, Gearbox acquired the license for Duke altogether, and has 'protected their IP' in a rather aggressive fashion, which has resulted in this topic.
was Duke Nukem Forever really that bad of a game ?
This isn't about DNF.
their illegal as shit siphoning money from alien to put towards borderlands was unforgivable. not surprised at all they'd fuck over a disabled guy too. this kind of nonsense is just the natural result of suits who have no love for the craft they manage tbh
I like the Borderland series and I love that they gave the Homeworld keys to the original devs so they could make Deserts of Kharak and that Borderlands is back to being written by the original writer Michael Neumann(also Brother in Arms writer) but Gearbox plz. They're fucking bipolar with decisions, it's like for every good one, they make a really bad one.

Also, I think Deserts of Kharak was developed by another team (Blackbird?) and just published by Gearbox.
Yeah, Deserts of Kharak wasn't made by Gearbox.
While it sure sounds like Gearbox are shitty, I feel like putting that the guy is disabled in there cheapens the whole thing quite a bit. It has nothing to do with it.
It's hard to hate the guys who gave me Opposing Force, but god damn.
Whats up with all the guests / people viewing this? Did something happen?
Whats up with all the guests / people viewing this? Did something happen?
Something Duke related is going to be announed soon, likely the new version of Duke 3D.

Since this thread appears to be getting huge amounts of traffic from Reddit, allow me to give people an update on what happened since April, for those uninformed: First of all, the original topic regarding the whole "Gearbox vs Gobeille" deal on Duke4.net has been removed/made private, so most links in the Techraptor article are probably broken. This wasn't done because of pressure from Gearbox' side, but because Gobeille aka. TerminX decided to make another attempt at working together with Gearbox: [T]http://orig02.deviantart.net/d00d/f/2016/139/8/6/segwad_by_wesker500-da340i2.png[/T]
I didn't get any pressure from Gearbox, I just decided I would make another attempt at working things out rather than continue with the way that thread was going. The whole situation is distressing and a little heartbreaking. The Duke3D community is very dear to me and I don't want to do anything that will fuck it up forever. The situation is what it is and I don't want to go to war with anyone if I don't absolutely have to.
For those still questioning the decision to remove the original thread, another user on Duke4 put it pretty well:
old thread full of slander and insults due to emotional distaste of how a certain situation went down. As long as this one stays "civil" it will probably continue; otherwise I'm guessing it will "disappear" as well if it gets out of hand again. When you're trying to negotiate with someone on "friendly" terms, it's not a good tactic to have an open portfolio full of negativity.
Anyways, later in June, Gobeille made a public statement regarding the whole licensing deal. It turns out that it was, in fact, invalid after all, and that Gearbox had been in the right with their claim:
OK, here's the deal. Our license to Duke Nukem 3D is invalid. It's not the fault of the current owners of 3D Realms, and, as it turns out, certainly not the fault of Gearbox. This leaves me completely up shit creek. BUT, even after the public feuding, Gearbox has found something for me to do and they are going to be helping me out, as is 3DR. As far as Hail to the King Collection goes, there's not much more I can say other than that it's on hold at 90-something% completion. Gearbox isn't currently interested in the product and they aren't obligated to be. At this point, I'm just glad they're willing to work with me again. I'm going to do my best to change their minds on it as I believe the market for such a product is much larger than they think it is, but for now it is what it is. I may just do a "soft" launch of the base port itself for a $1.99 price tag where you provide your own GRP. So, to summarize: Gearbox isn't evil and Randy isn't a huge asshole. The current owner of 3DR is a great guy. I got completely shanghaied, but things will be alright.
The party responsible for the shoddy licensing deal is very likely to be the founder of Apogee Software, Scott Miller. And at this point, it is currently unknown if TerminX will take any further legal step against those responsible.
