I got arrested yesterday. One of my friends, A, works at a warehouse that his family owns. No one goes in that warehouse so he said we could use it to smoke ant shit, so we have been.
We pulled in the warehouse, parked in there, then went to the office room where we hang out and started chilling, then i hear a knock on the door, and its a cop. I tried to shut it and freaked out, tried to hide the bud, and then they came in and i just sat down.
They asked us what we were doing there, and we said it was kind of obvious, and then called in more officers. Im 17 years old.
It was me and 4 other people, and since none of us narked, they ended up giving us all breaking and entering (felony) possession of a felony amount (it was like 45 grams or soem shit, but they weigh with the bags so thats bullshit) intent to distribute (They found two scales and little jewlry baggies randomly scattered) and paraphenalia.
Im supposed to be hearing back from colleges in 15 days, i was wondering if ANYONE had any tips help or input to help me out.
Oh and if you didnt know i definitely quit fucking smoking.

To be honest DD isn't really a good place to get "lawyer" advice no where on the internet is.
Yes, i went to jail, they handcuffed me, fingerprinted me, photographed me, and then i called my dad, and left on bail.

They said the bay door was open, and they have had problems with break ins, so went in to investigate, then saw the cars and heard us.
Well if your friends family doesn't charge you for breaking in your good on that..
now the other stuff, you better get a damn good lawyer. Make sure he is well known in the community.

Unless sweeping legislation is passed that not only makes weed legal, but legal for people under 21 in your state, I'd say there isn't much of a chance of charges being dropped.
If weed legislation does happen all past laws that made it a criminal act still stay. Meaning if you are arrested and sent to court before its legal you have to serve the sentence.
No pardons will be given

OK so who out of your friends was the real owner of the weed? Is it you that was selling? Did they find the weed/paraphernalia/scales on anybody person?
If you can honestly say NO to either of these questions, your buddy is going to have to fess up when it comes time to talk to a judge. I don't care how good of friends you are with him. You're dont want a FELONY on your record.
You might end up with a breaking and entering charge, and your lawyer (good thing you are getting a lawyer, it makes ALL the difference in the world) may be able to work a plea deal with the prosecutor where you DONT get a felony charge. If you dont have an priors, thats great. Buy a nice suit (THAT FITS) and look SNAZZY AS FUCK for the judge. Tell your lawyer that you're planning on going to school and doing something with your life.
It's not the end of the world, you can work something out. Just get a fucking lawyer ASAP. Don't say anything that may get you in trouble to your friends. You will have to talk to a lawyer because he knows the laws in your state/county.
Just get into the mindset (which i'm sure you are) that you just want to get passed this , and leave it behind you. When I got arrested, I stopped smoking for 2 months this summer.

You could try talking to a NORML lawyer, they are great at handling weed charges.

Get a lawyer that goes to the court a lot, where you're supposed to appear. That means he's probably really good friends with the prosecutor there. Don't get those lawyers that are going to send you shit in the mail because your name and address is posted in the paper since you got arrested.
And make sure you have your teachers right a report on how your doing in there class

I was reading up on breaking and entering, and apparently you have to actually break the lock and enter for itto be that, but however, all i did was enter through an open bay door, so i may see if i can get that to tresspassing from b&e.
All the weed was not found on anyones person, but it was found on the table and shit, same with scales. Scales were in desks n shit that they searched.
Any proof that the bay door was open?

they only got verbal permission from the kid of the family that owns the warehouse, there's nothing official about that, and i daresay the owners never gave their permission in the first place
Hmmm.... if the friend of the family who owns the place was with them, maybe he can convince his parents to say they gave consent? That'd be the easiest way out of any trespassing/B&E charges. He's getting fucked for the possession/intent no matter what though.
tbh you are really fucked man. My friend took the blame for us getting busted with only 6-7 grams, and a shitton of paraphernalia and he barely got off with a dismissal (basically he has random drug tests for a year and if he ever gets into any trouble with the police within the year they can reopen the case). And that was with one of the best drug attorneys in the area since he a) was a former drug [I]prosecutor[/I] b) was college roomates with the fucking judge and c) knew the arresting officer/dealt with him before. No felony charges though, so i can imagine your situation is tons worse and an outcome like my friend's is a long shot. The only thing different is that you are a minor, so that might help you out a little. I dont know how they are going to pin all of the drugs on all of you, so maybe there is some wiggle room there, but as for college good luck getting financial aid or anything like that cause with a drug felony that shits gonna be nearly impossible.
With a good lawyer, he can probably bring the charges down a little as there's no way to pin all the paraphernalia on him, unless his friends are ratting him out behind his back. If one of the 4 guys take the fall, the others will get let off. Otherwise they're all facing charges. Also, OP, remember that the cop isn't the one that CHARGES you with a crime, it's the DA. The charges you're currently facing aren't necessarily the charges you'll be facing in court.
Aetna has a point and if the parents are cool enough they can say the scales were theirs for w/e legitimate reason. Since the fact they were found in a desk at the time and its just coincidence...maybe it could hold up...but 4 grams of weed between. You and freinds can be your defense against the idea to sell it due to the fact its not enough between all of y'all ...its fucked how they can charge all of you for the same amount each...

Since nobody talked, they charged everybody with the same crimes for the same paraphernalia/drugs, which is what they did in my case. Doing this is strategic on the cops part because if you really aren't selling, it's in your best interest to get the others to fess up. It's really fucked up, but they pretty much made it a free for all against you and your friends. I have a question, because they dont have statements as to who's bud or whatever it is, and we have an arraignment tomorrrow,
hypotehtically, Is it possible that before the trial instead of 5 x felony amount of marijuana, each person could put a statement like "i had 11-12 grams of pot' and instead of 5 x the felonys, it would go down to misdemeanors?
It depends what the law is in your state. That's something you would have to ask your lawyer. Your lawyer(s) could say that it was equally everybodys pot, If 11-12 grams is considered a misdemeanor charge (i know here in florida <20 grams is misdemeanor).
