Other defendants include second amendment foundation in bellevue, wash. Foundation official keeva segal, who is allegedly associated with the publication women & guns and the website womenshooters.com, was also sued by righthaven in u.s. District court in las vegas.
Website operators accused of cybersquatting by station
station casinos accused two websites of cyberquatting and trademark infringement in separate lawsuits filed in u.s. Distrcit court in nevada.
Ryan murphy, a british man who allegedly runs the website stationcasino.org was sued by station. S.l. Enterprises, which is allegedly involved with the domain name vegasstationcasino.org was also named in a station lawsuit. Murphy's website is allegedly associated with gambling activities.
The anticybersquatting consumer protection act prohibits cybersquatting as an activity using a domain name with bad-faith intent to profit from another entity's trademark.
Spotlight on mers decision in 2009 lv bankruptcy case
a 19-month-old las vegas bankruptcy court decision involving the electronic mortgage registration system has moved into the national spotlight as the system's role in home titles becomes more controversial.
Critics of the registration company say the system has no right to foreclose because it does not possess the promissory note, mortgage or trust deed.
In her march 2009 decision, u.s. Bankruptcy judge linda riegle ruled that the system wasn't a true beneficiary under a trust deed.

Attorneys general of all 50 states announced oct. 13 that they're opening a joint investigation into home foreclosures.

Twoplustwo owner mason malmuth told pokernewsdaily that boyd had filed counterclaim against twoplustwo and had also filed a motion to dismiss the interactive company's lawsuit.

Commerce leaders, company owners look for answers from candidates
By VALERIE MILLER
Hotly contested elections are expected to go down to the wire this week. The most watched race has Senate Majority Leader Harry Reid, D-Nev., squaring off against Republican Sharron Angle, the Tea Party favorite.
But restaurant owner Sam Facchini is more concerned about paying his workers than party politics.
The co-founder of Metro Pizza hosted a National Restaurant Association political fundraiser for Republican congressional candidate Joe Heck recently. Still, Facchini said his politics are tied to survival.
The entrepreneur built his business into a string of local six pizzerias. Now, Facchini frets about his company's future. A dire local economy and the passage of extensive -- and potentially costly -- health care reform legislation are seen as threats.
"I am more than opposed to the health care reform bill. I am scared out of my wits about the approaching $2,000 charge," he said. "The restaurant business is labor-intensive, thin-margin type of business."
Under the health care reform measure, a penalty of $2,000 per employee would apply to companies with 50 or more employees that don't offer health benefits. Small businesses would likely be the most affected. And that $2,000 can end up totaling $300,000 when multiplied by Metro Pizza's 150 employees, Facchini said.
"Tell me where I am going to get the $300,000 to pay this," he said.
Incumbents who voted for health care reform could face the wrath of angry business owners, said Eric Herzik, a University of Nevada, Reno political-science professor.
"Now, small businesses are saying Obamacare will bankrupt them," Herzik said.
Congress' passage of the Health Care and Education Reconciliation Act of 2010 is a major reason Facchini is backing Heck, a former state senator. The Republican is challenging incumbent U.S. Rep. Dina Titus, D-Nev. Facchini disagrees with Titus' vote for health care reform.
Health care reform, taxes, job creation, government spending and Yucca Mountain are all major issues for Nevada businesses and industry leaders. However, the allegiances of businesses owners and operators are as divided as those of the rest of the nation.
TAKING SIDES
A business' size matters when it comes to picking a candidate to back, political observers said. Corporate leaders are likelier to support the candidate with the most power, regardless of party affiliation. Small and midsized companies want to know what an elected official will do to help with their specific needs.
"Small-business owners have less flexibility, and less time to wait for success. A small-business owner can close down in 90 days," said Mark Peplowski, a professor of political science at the College of Southern Nevada. "Small-business owners want the government to do more to stimulate the economy."
Jonathan Fine, owner of Sting Surveillance and two local bars, said he approves of Harry Reid's and Titus' efforts to create jobs through stimulus programs and renewable-energy initiatives. He's contributed to Harry Reid's federal re-election campaigns, and donated to County Commission Chairman Rory Reid's gubernatorial bid. Fine also hosted fundraisers for Harry Reid and Nevada Secretary of State Ross Miller.
"I believe in what they are trying to do," he said of the Democratic candidates.
Fine is not opposed to raising taxes if necessary.
"I'd pay more, if it makes sense, to help our school system," he said. "But I also think there are a lot of government inefficiencies that could be corrected."
But Facchini's foremost concern is his business' survival. He supports Heck and said the Republican candidate is in touch with small businesses' needs.
Facchini is also chairman of the National Restaurant Association Political Action Committee, which sponsored the recent fundraiser for Heck.
Facchini doesn't like the country's direction.
"We have a terrible unemployment situation and a terrible development situation in Nevada," Facchini said. "I think the government is spending us into oblivion."
If two candidates are locked in a tight race, a conservative streak may come out in small businesspeople, Herzik predicted.
"Small businesses tend to lean Republican, and because of that, I think Angle has an advantage with them," Herzik said. "She can say, 'Kick the bums out' about (Harry) Reid, (House Speaker Nancy) Pelosi and (President Barack) Obama."
Reid has gained the support of prominent business leaders such as MGM Resorts International CEO Jim Murren, Greenberg Traurig Las Vegas managing shareholder Mark Tratos, and the backing of Republicans for Reid. That group is led by political kingmaker Sig Rogich.
"I think the gaming industry is supporting Harry Reid almost unanimously, and the business community is supporting Harry Reid," Rogich said, naming off some of Reid's big backers. "John Gibson of American Pacific (Corp.) is one. They know what he has done for Nevada."
Rogich, a longtime political consultant, is critical of Angle's views. He said Nevada businesses are supporting Reid.
"I think the business community thinks of her as an embarrassment," Rogich said.
Former Gov. Bob List, the leader of the National Republican Committee, ignored the jab at his candidate, saying, "That's what you'd expect from a Reid supporter."
Rogich said Reid's clout is also needed to stop the Yucca Mountain nuclear repository. The revival of the proposed nuclear waste dump, just 90 miles outside Las Vegas, could devastate the state's economy, Rogich warned.
"Any small (nuclear waste) spill and Las Vegas would become a ghost town," he said.
FIGHTING DOWN TO THE WIRE
When businesspeople pick a candidate this election year, they aren't afraid to argue passionately for their choice. Mark Tratos hosted a fundraiser in September for Harry Reid. Like Fine, Tratos' party backing goes down the Democratic ticket to Titus and Rory Reid.
Tratos, however, said his efforts to re-elect Harry Reid are not partisan.
"Many, many Republicans are backing Harry Reid because of what he has done for Nevada," said Tratos, who runs one of the state's largest business law firms.
"Wall Street invested billions and billions of dollars in Las Vegas and that allowed our growth. That would not have happened without Harry Reid cleaning out the mob influences when he was on the Nevada Gaming Commission," Tratos said.
But List argued that Reid has burned bridges with small businesses.
"Clearly, Senator Reid has been no friend to small business. He supports organized labor and organized labor supports him," he said. "Sharron Angle has gained the support of the small-business community across the country."
CAMPAIGN PROMISES
Candidates are not giving up an inch of ground when it comes to courting businesses. Heck and Titus both contend the small-business vote can be the tie-breaker in their toss-up race in Congressional District 3.
"I think the small-business vote is critical," said Heck, who owns a medical practice. "I understand their plight because I am a small-business owner myself."
If elected, Heck pledged to change the recently passed health care reform law. He wants to eliminate extra costs to small businesses, and improve small companies' access to capital.
"The last thing small businesses can afford are more costs," Heck said.
Heck's opponent, Titus, has also wooed local business owners. She's held two business forums and promises more tax breaks for small firms if sent back to Washington, D.C.
Titus favors a measure to exempt 100 percent of the capital gains tax on small-business expansion. She also supports increased government contracts for small firms and 80 percent tax deductions for business lunches. The current tax deduction is 50 percent.
She voted against the Small Business Jobs and Credit Act of 2010 because of a lack of assurances that community banks would boost lending to small businesses, she said.
"It sounded good, and the spin was good, but banks have plenty of money to loan. There should have been greater guarantees," Titus said.
At press time, Shelley Berkley enjoyed a substantial lead over opponent Ken Wegner in her bid for re-election on the Congressional District 2. But she wasn't taking the business vote for granted.
Berkley is pushing for 100 percent deduction for small-business lunches. She argued the exemption is vital for mom and pop operators who use the lunches to court new clients.
Berkley also favors eliminating the estate tax so that small-business owners can pass their companies down through their families.
"If the estate tax comes back, it will decimate small businesses," she said.
Heck wants to lower the federal corporate tax rate to 10 percent to keep jobs in the United States.
"People say the federal government doesn't create jobs, and we don't," he said. "People are moving jobs (overseas) because they don't want to pay high taxes."
Former attorney general and federal judge Brian Sandoval has a big lead over Rory Reid in the race to replace Gov. Jim Gibbons, but both are still courting business voters.
Tackling Nevada's projected $3 billion shortfall and diversifying the economy are the top issues.
Rory Reid pointed to the county's high credit rating under his tenure as evidence he can run government like a business.
Meanwhile, Sandoval has promised not to raise taxes. He also pledged to be involved in working with the Nevada Development Authority, and other state entities, to bring jobs to the Silver State.
"I will be picking up the phone and making the calls personally to companies," he said.
Sandoval slammed Rory Reid's budget plan.
"Rory's budget plan is an abject failure. It involves $615 million in money that doesn't exist," he said.
Rory Reid countered that it is easy to criticize when you don't have any plan yourself. He said Sandoval's run was conveniently timed.
"I think he thinks he can ride this wave of discontent into the (governor's) mansion," Rory Reid shot back.[/quote]
