It was interesting seeing the whole story behind this since it's one of those 'everybody sues everybody in USA'-stories you always hear here in Sweden. I've always thought everything was retarded about this but now I've changed my mind.
But but but... Corporations are people too!
I had found out a while ago the coffee was so hot it gave her third degree burns on her legs, way the hell above a safe temperature to ever have coffee. Like, it had to be just short of boiling.
It's always one of those stories people bring up with a little laugh, "oh if you can sue for spilling coffee on your idiot self you can sue for anything!", often after you do some dumb thing like trip on a step or hit your funnybone on a chair. I give people a good rundown of this story whenever it comes up
...Interesting.

Holding the cup between your legs and then removing the lid is simply compromising the cup's structural integrity, though. I mean, she should definitely get her medical bills paid, and McDonald's should be fined for ignoring the issue, but that action was pretty stupid.

the fact of the spill is entirely her fault, but it should have been uncomfortable and left her a little red, not melt skin. Imagine if she even attempted to take a sip, it would have in the very least wrecked up her lips if that's all it hit before she recoiled in pain, at worse it could have gotten in her mouth and permanently damaged her tongue. What could it have done to her esophagus?
This isn't "someone was drunk driving, crashed a car and the airbag failed to deploy, and is now suing car manufacturer", this is "some human made a serious error with the coffee machine and gave it to a customer who did nothing wrong but fumble with the cup to put sugar in."
McDonalds got what they had coming. Sure they lost some pocket change but in the end they had no choice but to change the temperature of their lava coffee.
As an employee of McDonald's, everything on the burner is kept at 199-201 degrees. Slightly shy of boiling. I have had so much coffee spilled on my hands and arms that I can say it does indeed suck. But if you are clumsy enough to spill 12/16/21 ounces of coffee on yourself then it is completely your fault.

are you covered in third degree burns
This is enlightening, relieving, and infuriating all at the same time

Well, I don't know the facts, but I think this case depends entirely on that that 30F difference is the delta between getting burns, and not getting burns. You should always be careful with hot contents, and while I think McD is in the wrong for serving it that hot, I sincerely hope other people who weren't themselves at fault in the spilling got a larger compensation. Actually, I think all the compensations should be smaller, and the fine to McDonald's should be very large. I mean, there shouldn't be that much of an economic aspect when suing, it should be more idealistic.
I think the woman sincerely just wanted McDonald's to change their policy, and I don't think the ruling is unjust, but I don't really like the principle.
more interestingly, how many people have been burned by mcdonalds apple pies but couldn't voice their story afterwards
are you covered in third degree burns
The thing that ultimately caused the severity of the burns wasn't the temperature of the coffee itself, but rather how long it was in contact with her skin. She was unable to get out of the car quickly and thus, was unable to get the stuff off of her, so the 180+ degree coffee was in contact with her skin for far longer than in JakeIsWin's case.
Doing the math she definitely had critical burning. Honestly if spilling coffee that was so hot causing 3rd degree burns and putting you into shock then yes, you should be compensated.
Coffee cools down very quickly once away from the heater... I WANT it to be ridiculously hot when I buy it.
If I can hold the cup without burning my hands then it isn't too hot.
watch the documentary on Netflix called Hot Coffee, it goes in depth with the case, and how corporations smeared it to seem like they were victims of lawsuits and ended up capping all lawsuit payouts all over the country. Shits really fucked up.

I'm quite the opposite when it comes to this. Sure, it's nice with hot coffee but at the same time it's annoying as hell when you have to wait for a 100 years for it to cool down enough to become drinkable.
Well the way the victims wanted it was to be settled out of court. If you look at all the records they show McDonalds paid out to their coffee victims was anywhere between a measly $10 and almost $30,000
The victim only wanted her medical bills sorted, and McDonalds refused twice to settle it out of court, and the actual amount she awarded was only half a mil.
Why is the coffee so ridiculously hot anyways? The coffee doesn't benefit from it at all.
I hate it when I get a coffee and it's brewed by satan himself and is basically engulfed in flames when they hand it to me. Then I have to wait for 30 minutes for it to cool down to a temperature that is even humanly possible to consume.

Normally I have to wait a few hours before the things I eat and drink burn my anus.

Probably because their mouth was burned all to hell :v:

I thought she got fourth-degree burns, since it actually burnt her bones.
well i feel like a dick

Just go to White Castle you won't have to wait a few hours.
scary how distorted the view of this case is by the general public (and around the world)
I didn't know it was this serious until now.
I feel like an ass for laughing with people about it
I thought this was well known already?

But here's the thing; they didn't do it properly when they gave it to her. They just stuck some leftover coffee in the microwave. This made it too hot. It was hot enough to cause 3rd degree burns. So even if she didn't spill it on herself she most likely would have burned her fucking tongue off.
