When Apple’s patent battle with Samsung heads to trial next week, the iPhone maker plans to build its case using its Korean rival’s own words against it. An unredacted version of Apple’s trial brief bluntly states that Samsung was well aware that its smartphones and tablets bore a striking resemblance to Apple’s iPhone and iPad and that the issue was one the company discussed internally.
“Samsung’s documents show the similarity of Samsung’s products is no accident or, as Samsung would have it, a ‘natural evolution,’” Apple argues in its brief. “Rather, it results from Samsung’s deliberate plan to free-ride on the iPhone’s and iPad’s extraordinary success by copying their iconic designs and intuitive user interface. Apple will rely on Samsung’s own documents, which tell an unambiguous story.”
Among those documents are a few purported to show that Samsung not only deliberately copied certain characteristics of the iPhone and iPad, but was also explicitily warned away from doing so by various third parties, including Google. Below, a sampling of some of Apple’s more compelling points excerpted from its brief.
In February 2010, Google told Samsung that Samsung’s “P1” and “P3” tablets (Galaxy Tab and Galaxy Tab 10.1) were “too similar” to the iPad and demanded “distinguishable design vis-à-vis the iPad for the P3.”
In 2011, Samsung’s own Product Design Group noted that it is “regrettable” that the Galaxy S “looks similar” to older iPhone models.
As part of a formal, Samsung-sponsored evaluation, famous designers warned Samsung that the Galaxy S “looked like it copied the iPhone too much,” and that “innovation is needed.” The designers explained that the appearance of the Galaxy S “[c]losely resembles the iPhone shape so as to have no distinguishable elements,” and “[a]ll you have to do is cover up the Samsung logo and it’s difficult to find anything different from the iPhone.”
Damning stuff — as presented in this context, anyway. And it will be interesting to see how Samsung’s legal team rebuts it. That said, Samsung does have some ammunition of its own. Specifically, some 2006 internal design presentations that outline a mobile UI similar to the one that ultimately debuted on the iPhone, a handy before-and-after-the-iPhone-handset comparison and some internal Apple emails that it claims suggest “Apple’s ‘revolutionary’ iPhone design was derived from the designs of a competitor — Sony.”
Add to that Samsung’s claim that Apple’s lawsuit is anticompetitive and its argument that the iPhone maker should pay it for using patented technology, without which it “could not have become a successful participant in the mobile telecommunications industry,” and next week’s trial is shaping up to be a contentious one indeed.[/quote]

They're just fucking phones.
The "before" and "after" phone designs don't look very different on that picture...
Not exactly surprising. Dude A makes a product that gets immensely popular, Dude B copies it to try and get a piece of that success.
Funny how the phones on the before part are after the release of the original iPhone according to the image.
If Apple cares so much about copying, why don't they target the hundreds of chinese manufacturers copying every aspect of their devices?
Oh wait, it's because they don't pose any competition to Apple.
They all look the same to me.
You can't claim the rectangle and say that any other rectangle shaped phones are copies.
IMO Samsung phones are better. Faster and more durable plus they don't fuck up my wallet when I want a newer version.

...The ones before look like the iPhone way more.
I like how all the phones are resized to make them look like they're copying the dimensions of the iphone.

announced before the iphone
I thought apple was supposed to say samsung didn't copy apple.
Not say they didnt copy THEN go back to "they copied us"

That was a UK ruling, I don't think it applies to anyone but Apple UK. Which is kinda shit to be honest, our judges seem to be the only ones fed up with this shit that still have the sense to just throw the case out.

that only applied to one tablet in the UK, and it was postponed to october
-snip- misinterpreted sarcasm

Maybe it's because of where I live or where you live or whatever but over here, the S3 costs 540 at its cheapest, about 60 euros cheaper than the 4S and in fact 40 euros more expensive than the 4. That sounds like fucking up wallets to me.

Still hung up on that screenshot of the galaxy s with the app drawer up I see.
The "before" and "after" photos look the exact same.
What the fuck do they want anyway? A phone that looks like a buttplug?
Apple are just mad because Samsung are doing what Apple does, but much better.
Are they still throwing a tantrum? Will someone give those kids a cookie or something?
I fail to see the difference between the pre- and post-IPhone eras. The only clearly identifiable trait is screens getting bigger and extending more towards the edges of the cover, but that happened with practically everything with a touchscreen around that time because technology advances.
Cell phones all look the fucking same holy shit.
I wish more people would just tell Apple to STFU.
Apple straight up stole Android's notification system, I mean just ported it right over so they really shouldn't have a leg to stand on
Personally I don't think either side should give a shit, when the other side copies your innovation it's time to innovate again

Also it has to be taken into account that we have been, and we continue to be creating a new type of device with new paradigms here
Can you imagine if the mouse had been patented and no one else was allowed to use it, or the QWERTY keyboard, or the concept of program windows, it would have been total bullshit
new things are copyright (c) apple circa 1 a.d. - the present
Wow it's like the majority of the mobile phone manufacturers are reactionary companies or something, who would have guessed!

The S3 came out within the last month while the 4s came out last November. Difference being that the S3 will be brought to a more reasonable price far sooner than the iPhone will.
Gods, how is Apple able to get so far with this bullshit? Are the judges really that amiable to them that they can't see past the fundamental conflict this whole thing is brewing?
And how the hell are patents allowed to exist for basic concepts? The iPhone has a very easy to replicate, very general design. It's literally just a rounded rectangle with a screen. That's it. It's an efficient design. This would be like every car maker suing each other for the standard sedan design.
It's bad enough they pulled that bullshit with fucking numbers in the phone's webbrowser being callable when you tap them, because somehow, that's a feature exclusive to Cupertino's magical slab of plastic.
[editline]27th July 2012[/editline]
The worst part of all this is, they're only going after Samsung because Samsung poses a threat to them, now. How much has the S2 and S3 sold?
