Don't see how any jury would send someone to jail for something that's clearly posted out of aggression and frustration from playing a competitive game.
Pretty fucked up joke if you're asking me, but not grounds to convict such a young person. Based on infinite precedent of this sort of thing happening on social networking, the judge really should've known better than to dismiss the motion.
The kid is still pretty stupid for posting that'd he'd shoot up a school in a country where that happens often.

Even though it looks like he was joking, you can never be sure. Like stated previously, it is never funny to joke about shooting up a school. What happens if he posted the comment and later did shoot up a school? You would all be saying "I thought the JK meant he was kidding" JK, LOL has no legal standing in the court system. Anyone can run into a building and scream "FIRE" and 2 seconds later say "LOL, JUST KIDDING," but that doesn't stop the fact you will be arrested for inducing panic.

Ignoring his obviously exaggerated-humor with regard to eating beating hearts, the simple fact that Carter said "just kidding" automatically fails the imminent lawless action test because his actions are no longer [I]likely[/I], or imminent. Shouting fire in a crowded theater incites immediate panic because the act itself incites imminent lawless action (e.g. a riot). Making a facetious threat on a passive forum to be followed with clarification indicating that it was joke is entirely different than inciting a riot at a movie theater.

This court case is a farce. How do they prove he was "actually joking"? How do they prove he wasn't? Are they going to look through his room? Are they going to go through his text messages/e-mails/private correspondance? If he said it somewhere else six months ago does that constitute that it was a 'real threat'? If he has a BB gun does that constitute 'gathering supplies'? Just how far back and how wide can they go to 'prove' that 'clearly he was lying about it being a joke'? How much of this kid's life are they allowed to rip open and scrutinize in front of the kid's community and peers? And beyond that: What is the Court going to do if they go through this whole thing and the kid is found not guilty? "Oops, we're real sorry"? And what about the reporter of the crime: what happens to them if they find the kid not guilty? They're in another [i]country[/i] for crying out loud. [i]Nobody[/i] gains from this case moving forward. It should've been killed, the kid potentially recommended therapy/anger management in a private consultation with the judge and the kid's parents at most, and the case buried for the sake of all parties involved. Pretty soon we're going to have it so that every and any threat, whether believable or not, is going to be dragged before 'comedy court' to determine whether it was a joke or not. Talk about making a "mockery of the justice system".
As soon as I saw this was in Texas, I understood why this court case wasn't thrown out.
Any sense of sarcasm is lost when you're writing something on the internet. Nobody here or anywhere else complaining about this case seems to realize that. We're used to it by now because most of us have been on the internet now for a number of years. But when you mix people who've been on the internet for years with people who have little internet experience, it tends to not go well. Yes, it was a joke. But to anyone other than us, even with a "lol jk." The whole "oh its just a joke" thing isn't there. In general, what the kid said is not something you'd want to say in public and social media like facebook is basically like being in public at this point. If you wouldn't say it in public, don't say it on social media. Imagine if you heard what this kid said, but in real life. How would you react? You guys say it's just a joke, but you have to treat this stuff with some form of seriousness, especially given the recent turn of events of the past year. Not on the level that the cops took it.
