Why would they hire British people for spies? Wouldn't that be counter intuitive? I thought intelligence agencies hired locals for this kind of spying.

Isn't it pretty usual for any militarily active group to accuse of spying anyone caught in the wrong place? Like how Arma 3 devs were accused of espionage and imprisoned in Greece when they took photos and hanged around too close to a military facility. Only that IS fighters will just execute anyone they don't like anyway.

It's an antiquated concept. In older times, declaring a state of war would allow a government to activate certain special wartime laws and measures which wouldn't be legal or possible in peacetime. The US at least has never had a government system like this. Declarations of war have always been ceremonial at best.

Formally declaring war on ISIS would be tacitly legitimizing their claims of statehood.
