She refused the man’s demands for her to get off him and told him to be quiet.
Eventually he was able to squeeze out from under her and force her out of his apartment.
A sexual assault examination was performed on the man later in the day with DNA found on him said to match Gilman.
Gilman told police she didn’t remember having sex with the man and described herself as mentally ill.

It probably has to do with the legal definition of rape. It varies from state to state, but typically it's not considered a full rape unless the victim was penetrated.

Same ways there's degrees of murder. It has to do with intent, planning, and the degree of violent or otherwise malicious behavior involved in the act itself.

Because violent rape is worse than non-violent. Both are bad but regular rape is worse than raping someone asleep/unconscious and rape combined with violent assault is worse than regular rape.

But lets imagine a 110kg man breaking into a woman's apartment, pinning her to the bed, and raping her. Would he get 1st or 2nd degree?

Seems pretty clear that it should have been first degree, but it could be the prosecutors know something we don't and decided to go with second degree because it offered a much better chance of conviction.
