Sony wins a temporary restraining order against George Hotz

Sony has convinced a federal court to issue a temporary restraining order that bars a hacker from distributing his technology for running unauthorized software on the PlayStation 3. U.S. District Court Judge Susan Illston in San Francisco found that Sony had submitted sufficient evidence to show that it would suffer "irreparable harm" if the hacker, George Hotz, continued to distribute his technology for circumventing the PS3's firmware that's meant to prevent running a separate operating system on the video-game console.
The court also ruled that Sony had submitted "substantial evidence" showing Hotz had violated the Digital Millennium Copyright Act by making it possible to run pirated software on the PS3. Stopping others from running such software was in the public's interest, as it prevented copyright violations.
The order, issued Wednesday, bars Hotz from "creating, posting online, marketing, advertising, promoting, installing, distributing, providing, or otherwise trafficking in any circumvention technology, products, services, methods, codes, software tools, devices, component or part thereof." Hotz is also barred from posting links to any Web site offering or promoting such technology.
The court ordered Hotz to turn over to authorities "computers, hard drives, CDs, DVDs, USB sticks, and any other storage devices" on which circumvention technology is stored.
Hotz's lawyers had argued that the court did not have jurisdiction over the case, because Hotz does not live in California. The court disagreed, saying Hotz's alleged activities had an impact on California. Illston said Hotz could bring up the argument again at a later date.

Hotz, aka "Geohot," first gained notoriety in 2007 when he hacked his Apple iPhone in order to use the smartphone on multiple carriers' networks. Apple at the time had an exclusive deal with AT&T. In late 2009, he turned his attention to the PS3 and documented his attempt to hack the system on his Web site.[/release]

Are you guys seriously complaining about this? It sucks for us but legally and, in my opinion, morally it's all sound. If your life's work was to create a product that you could profit from by sales of the product and subsequent products used with it, you would do EXACTLY the same thing if someone started trying to chip away at your profits like this.

For fuck's sake is just a temporary restraining order....its not a full blown lawsuit. They have learned...not as much as we hoped but I think they've leveled up to 13 year old girl bitching about her BFF.
In most cases when any kind of "proof" is given a TRO will be granted. To be honest this means nothing. We might here more news tomorrow as each side was told to meet by February 1st.

That's all good and well but I can't help but feel that's about as legitimate as Limewire being (really, not just a press release every once in a while or something) against file sharing.
The problem I see here is that on PC, at least, there are real, legitimate uses for sites like TPB or .iso download sites. If you've bought a game in the past and want to reinstall but lost a key or something, there's no problem with people using them. But what about on the PS3? I've not done my research here, so can someone explain what kind of legitimate uses this has on the PS3?

Modding games, homebrew games, and applications. Hopefully FOF will release a way to enable linux on the PS3 soon.
the only way to pirate games on GeoHot's firmware is to use a hacky work-around to install the game as a package. most pirates are using firmwares made by other people.

You bought the PS3 hardware. Why isn't it your right to modify the software on it?

I don't think geohot or anyone else at failoverflow would want that. One of their goals is to circumvent piracy to lighten their image I believe.
