Today I got a text fro my friend, basically saying that my boss at work told another employee that she can get fired for saying "inappropriate" things on Facebook. At first I heard this and thought that's some bullshit! Since when did we lose our first amendment rights? I did some searching and I stumbled across a few testimonials from people who had lost their jobs for stating that they thought their work was uninteresting. Here's a few of them.

The third link was the most useful to me. It stated that employees can quit for any or no reason at all, and that employers have to right to layoff, or fire employees for any or no reason. However, it would appear that firing someone based on their opinion of their workplace is a violation of freedom of speech. I know people like to say freedom of speech means they can go on National television and say they're going to kill Obama, without consequence. This is a slightly different situation. While people who don't want to be there, don't HAVE to be there. If they truly were upset with the job to the point it was unworkable, most people would quit (unless money is in dire need).
Some stories I've seen posted around on the internet feature people getting fired for nearly nothing at all. Some people have simply stated that they had a boring day at work, or they aren't entirely interested in the field they went into and have gotten canned for it. This seems like it should be illegal. One, because Facebook is personal, not professional. How does someone have the right to fire someone based on what they're doing in their own personal life, when nobody is being hurt or deprived of their rights. To me, this whole ordeal sounds like people getting fired for voicing their opinion. There's my two cents, and I want to hear yours. Is it legal for employers to fire based on people exercising their first amendment rights?
If it's slander it's illegal.
It's not violating first amendment because companies can do whatever they want, it just that government can't put any unreasonable restrictions on speech.

Sure you can add fellow employees but goddamn don't talk about what you think of work or how your day at work was or anything related to your work. Talk about work at work or at social gatherings, don't broadcast it on the internet.

Here's something I thought of but isn't ertirely my opinion:
Why keep someone who doesn't want to work instead of someone that does want to work? I would think the quality of work would be done better by someone who liked their job...just a thought.
Don't say negative things about people in text, it isn't that hard. If you don't do it, you won't get fired or anything.
If you say that your job sucks over facebook you really should sell your PC and get some friends.
A lot of teachers aren't even allowed to [I]have [/I]a facebook account.

I am not a lawyer, but I think freedom of speech basically guarantees that you won't be arrested for communicating your views. It doesn't mean that everyone else has the obligation to do business with you no matter what you say
There are employment regulations, of course, but they don't cover bitching and moaning
I think the #1 legal consideration over stuff like this is that Facebook is considered a public place (with a very large reach). Saying something on Facebook is technically a little bit like walking downtown with a megaphone and saying it.
first amendment only protects us from being arrested for what we say.
Whoa, I am a boss and I own my own company. If you are working here and don't like it and and are talking trash about the company over the internet or anywhere else and I find out....fired. Disgruntled employees are like a virus among the staff. Best to nip that in the bud asap.
And with todays market being what it is here in the US, most people should just be happy that they have employment.
This has nothing to do with free speech, unless you're talking about a federal job.
I really hate it but it's completely okay most of the time for your job to fire you based off of what you say on the internet.
