I hope this guy's court case kicks the shit out of them, if this is all true.
Both parties are at fault to be honest. The officer could have just said "I pulled you over because <reason>, now please identify yourself" to avoid the whole mess of having to drag the guy out and lock him briefly up. If the guy failed to comply anyway after his question was answered then he would have been justified a lot more. The guy also could have tossed his license over too but there were apparently two other no reason stops previously.
The guy's wife is a third party at fault for not rotating her fucking phone for the video though, that and she was a bit too close to them.
The use of pepper spray though, especially WITH CHILDREN in the car is extremely questionable. Want to know how to get one, possibly two cases of life-long depression and possibly a suicide attempt(s) in the mix as well? This is how you do it, pepper spray one of their parents at quite young ages.
If I had to give a "most at fault" it'd be without a doubt the officer for the inappropriate use of the spray and for the upcoming mental health burden that I'm going to have to pay for some years down the road.
Wanna build distrust in cops from a young age? Randomly stop and pepper spray dad on the way to school.
Self-fulfilling prophecy at work, here. And then the cycle goes around and cops demand more laws to "protect" them against the citizenry whose trust they've abused to the point of total disintegration.

Honestly, I think the guy made a mistake trying to argue with a police officer. He should have complied, unfair treatment or no, and made a complaint later. With children in the car his first priority was not to let the situation escalate. Not saying the cop's actions were justified, but still.

I used to think like that too, but honestly fuck that. Why should you bend over backwards for someone who is there for your protection. He wasn't even belligerent and you have every right to know why you are being pulled over, for your own knowledge if nothing else.
Keeping silent at times like these gives the dick the confidence to do something similar to the next guy and the next. And complaining afterwards never gives you the same feeling of closure after being treated unfairly since you rarely know if or how the officer was reprimanded (unless maybe in Canada they do tell you the result of their enquiry, I don't know) and you let things go off to the wind of internal affairs and cops watching out for each other.
I might be wrong but I simply cannot see a call of "I was pulled over unjustly" made hours later having much effect.
For those who don't get the cowboy hat, it's because cops in Quebec have been in strike for a while, wearing camo pants and hats to protest....something I can't remember exactly. Hence the cowboy hat

Because playing the hero against (in front of) someone most likely armed on a power trip doesn't really get you anywhere at all

Exactly this, people are molded by their experiences and in these little girls experience cops will pepperspray your loved ones for hardly any reason at all.

Pepper spray is not a tool to subjugate someone just because you don't like their tone. It's to be used to disable a threat and force pain compliance on someone uncooperative.
Wanting to know why you're being pulled over is not a lack of respect for authority.

yeah sure I've heard it before it's just not a very useful way to describe the situation as the environment(Culturally and socially) in quebec is considerably different from any where else in the "Americas".
The use of "Americas" is usually as a large and vague term covering a lot of ground. I don't see it applying very well to a Quebecois issue.
