How is the boat even rocking like that when the water is completely flat?
It's like the boat is removed from existence when you are not looking at it but re spawned once you a looking a certain angle close to it.
Shouldn't spawn underwater.

The camera is applying a force to the boat, somehow. Silly czech developers don't know how to physics.
I've heard that it's a fairly buggy game. Strange that it wasn't noticed in development, because I'm sure it happens with other props as well.

I think it was San Andreas that the developers put in some gimmicky sea thing to kill you if you went into a certain direction far enough if you went via boat
Maybe it's a feature in the game, to increase performance... No use in having it suck up resources if it isn't on screen

This feature was in all 3d games starting from the very first one.
There's actually a huge octopus monster lurking right under the dock, pulling the boat under every time you look away, but he's very shy.

If the game uses havok by default, which I think it does, I'm pretty sure it's configured to work inside the player's 180 degree PVS state.

It does this in source sometimes too on lower end systems, but usually only when not inside your visual range.
I'm still going to buy it since i have a love Americana.
so if you look away for about a minute the boat will be upside down!

No that's dumb.
What's actually happening is it isn't being rendered when you're not looking at it to save performance, then it's put back afterwards. The issue is someone fucked up and made it spawn under the water.
Cthulhu is trying to eat it.
Camera has nothing to do with it. When an object is not in view, it's not rendered or calculated. When it is in view it's re-spawned back and this stuff like this happens.
