• Samsung seeks iPhone4S sales ban in Australia and Japan

This follows similar pleas by the Korean manufacturer in France and Italy claiming patent infringement by Apple. The move comes after a court in Australia temporarily banned the sales of Samsung's Galaxy Tab 10.1. The two companies have been involved in a bitter legal battle involving smartphones and tablet PCs. "Apple has continued to violate our patent rights and free ride on our technology," Samsung said in a statement. "We will no longer stand idly by and will steadfastly protect our intellectual property." Losing ground? While there have been claims and counter claims from both sides, Apple seems to be gaining the initial edge in the legal battle between the two. Last week, a judge in the US ruled that Samsung's tablets infringed patents owned by Apple. However, she said that Apple needed to prove the validity of those patents in order to win an injunction preventing the sale of Samsung's Galaxy Tab. This followed a ban by an Australia court on the sale of Samsung's Galaxy tab 10.1 in the country. Samsung said it had filed an appeal against the Australian court's decision. Apple has also scored a victory against its rival in Germany, Europe's biggest economy, banning the sale of the Galaxy Tab 10.1. Meanwhile Samsung's plea for a sales ban against some of Apple products was rejected by a Dutch court last Friday. This entire thing is ridiculous, but after all the crap Apple's been pulling, I hope this goes through, at least partially. Fight fire with fire. They get one real competitor in the market, and they do everything they can to push them out.
I hope Australia doesn't get something banned for once.

They sued Samsung for illegally infringing their Patents, which they have the right to do, Samsung are doing the same, neither of them are wrong or doing a bad thing by doing so..

Samsung ripped it off by making a Tablet with that shape, it wouldn't matter if they made any other electronic that looked identical, but the fact that it is a Tablet means it does. Also this isn't even about the Tablet, this about Apple infringing technology within the iPhone.

They are like two twins fighting. It's funny. Yes yes they each want to protect their patents and good on them for that, but it's getting ridiculous. Now it's just trying to block the sale of each others shit rather than solve the patent issues in a more suitable manner.

It will always be this way.

I do hope samsung does not win this one. While what Apple did was a real asshole move, many people want the 4S, why are you trying to take it away? I really thought better of samsung.

I don't really think Samsung have a case phone-wise. The only reason their phone looks like it does is because of the iPhone and their intent to steal Apple's customers by making something that looks almost identical, and they sell at a cheaper price. Of course, I realise that these patents aren't specifically about phone design (I think?) but Apple did pretty much invent and bring to the fore the modern smartphone.

A friend of mine has a ancient Windows mobile phone, and that's still considered a smartphone. And in turn, smartphones are more or less just PDA's that can do phone calling and handle SMS messages. So no, they did NOT invent the modern smartphone itself, they [I]however[/I] created a [I]need[/I] and a [I]market[/I] for it. And [B]THAT[/B] is what Apple's good at.

With the phones, Samsung's layout really is as close to the iPhone's as you could get without it being exactly the same. I can honestly see why Apple got shitty about it, and it escalated into something more. My HTC Desire's layout doesn't look anything like iOS, but my dad's Galaxy S2 uses the same general menu design and 4x4 grid with the same 4 buttons on the bottom as iOS does. I'm not saying it's right, but I can see why this all kicked off. Whereas other phone companies may have copied from the general idea, they at least tried their best to make it look and act differently, whereas the Galaxy S2 really does look like it's trying to imitate Apple in a lot of it's areas.

If it looks similar, so what? I've seen thousands of brands looking similar to each other. Besides the point, Apple has copied designs off of other people.
