While he was blacked out, she performed oral sex on him. Nearly two years later, she would accuse him of sexual assault. And under Amherst's guilty-until-proven-innocent (and even then, as we'll see, still guilty) hearing standards, the accused student was expelled. The accused student — using the pseudonym John Doe — is suing the university for denying him due process. His lawyer had discovered text messages that prove the accused student did not initiate the encounter and in no way sexually assaulted the accuser. Despite this evidence, the university refused to reopen Doe's case.

guilty-until-proven-innocent
Beyond disgusting.
Despite this evidence, the university refused to reopen Doe's case
Even worse, somehow.
I hope he drags both the accuser and institute through the dirt for all they're collectively worth.
Sounds like they're too afraid to create another mattress girl.
Guilty until proven innocent fucking what Seriously this alone is so wrong on so many levels
Guilty until proven innocent fucking what Seriously this alone is so wrong on so many levels
It's called blatantly obvious source bias. Even if this website wasn't an absolute joke (it is and you can tell by spending five minutes browsing their articles), this article doesn't have a single source citation and I can't find any corroborating sources.

Waiting for an actual news source before I commence the outrage. However if this is true it's really fucking bullshit and I'd say he has a case for a lawsuit and should go public with it.
both of these sources are terrible conservative rags
I guess you can just read the complaint itself: https://kcjohnson.files.wordpress.com/2013/08/amherst-complaint.pdf
How is receiving a BJ whilst passed out sexual assault? Wouldn't it be the other way around, if anything?
How is receiving a BJ whilst passed out sexual assault? Wouldn't it be the other way around, if anything?
If it's coerced or the person performing is being taken advantage of due to their mental status it's sexual assault. It can go both ways if both parties are drunk but it's really hard to prove sexual assault occurred in these cases because it mostly comes down to 'he said she said' (and subsequently get thrown out)
I guess you can just read the complaint itself: https://kcjohnson.files.wordpress.com/2013/08/amherst-complaint.pdf
Conservative biased BS. We should talk to the alleged college faculty and students so that we can get a 100% unbiased viewpoint, as anything that references this complaint isn't a real news source. [editline]11th June 2015[/editline] Wow, I'm reading that complaint. If their allegations are true and the evidence referenced does exist it looks like an air tight case.
66. DR was an upperclassman Residential Counselor who was friendly with Sandra Jones. Jones began to exchange text messages with him at approximately 1:14 a.m., just after John Doe left her room after she had performed oral sex on him. The text exchanges are attached in Exhibit 6. They disclose the following: Sandra Jones: Ohmygod I jus did something so fuckig stupid DR: What did you do Sandra Jones: Fucked [John Doe]. . . . FUCK DR: No you didn’t . . . . Sandra Jones: official story is he puked and I took care of him but yes. Yes I did. FUCK DR: [Sandra] what are you doing???????? Sandra Jones: Oh and apparently [ML]s coming over so nothing happened everything’s fine . . . 67. Jones went on to express her fear of the fallout when her roommate, EK, and others found out that she had had sex with EK's boyfriend, especially since, “I’m pretty sure [John Doe] was too drunk to make a good lie out of shit.” She said that if EK were to find out, “[S]he would literally never speak to me again.” DR then suggested that Sandra Jones “put all the blame on [John Doe].” Sandra Jones responded that “[EK] knows me it’s pretty obvi I wasn’t an innocent bystander.” They agreed that they both “hate[d]" John Doe. Sandra Jones then wondered that since she and John Doe “didn’t technicallyyyy have sex...[is it] not quite as bad?”
If this is provable they're gonna have a hard time defending.

Cunts like her take away legitimacy from serious cases.
When due process fails us, we really do live in a world of terror.
hey some people don't like random people performing sex acts on them
no, a guy got really drunk, passed out, and a girl gave him a blowjob, then accused HIM of sexual assault
Another false sexual assault claim getting some dude expelled from a university that blatantly ignores evidence. Didn't some bullshit like this just happen? I'm starting to think this kind of thing happens a lot actually.

Sounds like cases like these are getting more common Universities expelling students solely based on accusations I mean
Yeah, but how can you coerce someone to give you a BJ when you're passed out drunk.
It says blacked out though, not passed out, so I assume he was still concious but just can't remember anything.
Where's Flameon to defend her?

So this is kind of equivalent to the person being unconscious, you making them drink the tea, and then you saying that they, in fact, were the one who made you drink it.
Uh, why are people saying he was unconscious? The article says he was blacked out drunk, which means so drunk he didn't remember it afterwards, not passed out.
Uh, why are people saying he was unconscious? The article says he was blacked out drunk, which means so drunk he didn't remember it afterwards, not passed out.
Generally when someone uses the phrase "blacked out", it means unconsciousness.
Generally when someone uses the phrase "blacked out", it means unconsciousness.
Whenever I've heard it it's been in reference to not remembering. Passed out is passed out. Blacked out is no memory.
