Its quite clear from his stance that he was going to attack them. They probably asked him to drop it and lay down. Since he didn't do that, they shot him.

He only dropped his weapon to enter his badass combat stance, it was more of a "I don't need weapons to fight you" than a "I surrender".

He did, but I'm guessing that trench coat stopped most of the force so the pins didn't penetrate all the way.
