The cyclist sustained a life-altering medical injury. Pretty big difference. However, had the woman been injured, she would therefore have an emotional connection to the incident. She'd have a reason to care, because she'd understand what she had done. (Say she hit a car instead of a cyclist. Do you think she'd care then?) A significant portion of the population never develops to the post-conventional stage of morality. They can't put themselves in the place of others. They actually have to experience some form of pain to empathize with others. I'm not (Repeat: NOT) suggesting we go around slugging people with baseball bats. I'm not suggesting we go around shattering peoples' spines. That's horrible. However, if the woman had somehow experienced a fractured spine from this event, she would have been able to empathize with the cyclist. That's what I'm saying. Ideologically, I do believe punishments should fit crimes, but that's a whole lot of philosophical psychobabble that you probably don't care about.
