thats quite disturbing. So the guys original excuse was that he was trying to scam ISIS out of some money but according to evidence that the FBI found and stuff like this that he said it doesnt seem to be the case.

If i recall correctly, there is a nation control by a terror group or that the US considers a terror group and that's the one shelling Israel.
I'm kinda amazed they haven't officially invaded to take on this terror group that got in legally.

Except that we are. The Captain who did my swear in at MEPS last year said officially the US is at war still. And has been for the past 25 years or so. So yes we are, and shit like this is reason for treason charges

So a Captain said the United States is in a bona-fide state of war so that makes it true? I know a lot of O-3's who say funny stuff all the time. The fact of the matter is that the GWOT is not a war in the true conventional sense so actions like these wouldn't be chargeable as treason.
I'm pretty sure you don't need to be in a state of war to be charged with treason though.

We're not in an official, Congressionally-approved state of conventional war with another sovereign power.
That's the whole point of this conversation. Outside of those conditions, this man cannot be legally charged with treason. They can charge him with a ton of other things related to terrorism, but treason isn't among them.

You're right.
He didn't officially commit treason according to U.S. law because the U.S. believes its armed conflict against ISIS isn't a war, even though this citizen pledged allegiance to the enemy state and was planning an attack on his own sovereign state.
