A New York man who says a rat bit his penis during a jail stay may sue county officials, a judge has ruled.
Peter Solomon, who said he later had to endure a course of rabies jabs, says jailers knew the ward in which they placed him was infested with rodents.
He says the jail was negligent and mistreated him because he is black.
Lawyers for Nassau County sought to have the suit dismissed. Among other arguments, its experts said they saw no evidence of serious injury. Rodent problem disputed
In February 2007, Mr Solomon, a Vietnam veteran who says he has been treated for post-traumatic stress disorder, was jailed in the Nassau County Correctional Center near New York City, pending trial on charges he had menaced his wife.
He was transferred to a medical observation unit amid worries he was mentally ill. He claims at night a rat "or similar rodent" emerged from a hole in his mattress and bit him on the penis and hand, drawing blood.
Mr Solomon, who is in his 50s, claimed the county was indifferent to his treatment and failed to protect him from the vermin, and sued for damages.
County officials said they were shielded from lawsuits because they had acted in an official capacity, they were unaware of substantial risks, and they disputed the notion that a rodent problem existed in the jail.
They also noted the wound did not require stitching and that his injuries were merely psychological.
"The parties dispute whether the rodent was a mouse or a rat, whether Solomon was bitten or scratched, and the nature and extent of his injuries," Judge Arthur Spatt wrote.
He ruled on Thursday the suit may proceed.
Not sure if this has been posted or not.
The rat just wanted some cheese.
he should have caught the rat and stick it in his ass for sexual pleasure... but yeah this is pretty shite don't prisons have to abide by hygiene codes?

They do, but it's hard to prevent vermin from entering such a huge facility. The rodents probably hitch hike in cereal bags and linen deliveries, and get into the main structure without anyone noticing. Sort of like rats getting on a ship.

yeah but, there's a difference between a few rats sneaking in and an apparent "infestation"

It's not that hard for a few rats to turn into an infestation. They're almost as bad as rabbits. Also, don't forget the infestation, as of yet, hasn't even been confirmed
yeah that's why i put it in the "". i guess you gotta take this guy's word with a grain of salt, due to the worries about his mental health. still, if rats were somehow able to infest his cell or something i think that is pretty poor hygiene standards on the prisons side. sure it's easy for rats to spread but look at hospitals and fancy restaurants and hotels, they manage to keep that shit down
The rat came out of a hole in his mattress.
He was bitten on his hand AND penis.
It all adds up to him whacking it and the rat finally had enough and came out to tell him "Hey buddy, knock it off, people are trying to sleep."
When I read the title I thought he had intentions of suing this said "rodent".
Everyone knows why his penis was out.
He sounds pretty cocky about this case.
