I find the argument that the air conditioner must have been broken and he was leaning out to cool off to be rather unlikely. Unless the driver was planning on taking the wing mirrors off their car and their friend happened to be cooling of at the same time, they'd likely not have been close enough to get hit if they just stuck their head out.
