I don't believe that Burnout.Paradise.Xbox.megafag60.rar is entirely a freely available thing published by the authors of that copyrighted material.

The torrents are freely available, not behind a paywall, just simply linking to them is ok, but the act of actually downloading the content that is otherwise behind a paywall is illegal.
I think a great example of this would be that Facepunch can legally link to shitty drawings from DeviantArt without worrying that the shitty artists will come and claim they can't post their art.
