I'm guessing because the judges deemed her amount of physical resistance (despite the fact that she is drugged?) as insufficient; therefore she was deemed as consenting.

So if the rapist has a weapon like a knife or a gun that makes defending yourself extremely dangerous then it's not rape. Or if you're drugged, drunk or asleep it's not rape.

I like how everyone rated his unsourced post star and declared the case a cut-and-dry false accusation, while completely ignoring the issues highlighted in the original article: that the law has too-strict a definition of rape, which lead to the judge ruling her testimony as false in the first place.

After getting my search history fucked up, the only thing I can find is the title of a deleted porn upload denoting them as "türken". Whether they're born in Germany or not, chances are it has nothing to do with the current humanitarian crisis (especially as the case is from 2012), and probably nothing to do with asylum in general (as they're from Turkey).
Unless I'm totally off, it's probably just Pvt. Martin showing his ignorance as usual.

Didn't find an English source which also mentions the tests, but it really comes down to "We don't think you're right, there's no evidence to support that your claims. The only wrong thing that they did was publish the video."
This case has been mostly turned into a part of the bigger sexual discrimination debate.
