no they could not have used CryEngine 3 at all, it's not available to the public yet and FarCry runs on the original CryEngine.
So does every cryengine game have the word cry in the title or what
They should have just waited to make a port for cryengine 3.

The reason why Far Cry 2 is named as it is:
Both games are at locales that are foreign to many people on earth.
Everything, and everyone is against you basically.
You get a disease/mutation in both games.
The game play is actually similar to that of the other Far Crys on Xbox/360, just not necessarily the original.
You can play how you want, more so in Far Cry 2 due to openness.

I mean, what were they gonna do? If they launched another game under Far Cry title, it would already have a fanbase and publicity. I think the name is suitable, it just is lacking mutants.
The guy should have just remade the game from scratch using the CryEngine 2 (or 3, when possible).
