What state do you live in that actually prosecutes people for under an oz?

I live in California, which is why I asked the cop. I know the alw, but I forgot that cops are above the law. :rolleyes:

Isn't california decrim for under and ounce, like a $100 fine? if so it's the driving on the pavement I'd be more worried about, surely that's what you've been arrested for if possession is just an infraction?

He gave me possession with intent to sell. I got to admit though I did say I was going somewhere to dorp it off. In court I'm going to just say I was nervous at the time and didn't want to say it was mine, and that I actually was just gonna go get super baked.

So he pulled you over, told you to get off the bike, and immediately handcuffed you? There was no dialogue, nothing? Because of this I think the details of your story are a bit sketchy.

If the judge has any sanity at all, they would drop it down to misdemeanor, maybe even an infraction.

Unless you had scales cash and baggies on you they don't have any solid evidence against you, but it's your word against their's, and you broke the golden rule of saying anything remotely incriminating to a cop.

But no, ive been almost charged a few times with trespassing and such, and i just act really cool and dont talk.

It's pretty fucking nerve racking, I hadn't even said 10 words and I was in cuffs.

The suspect is merely released after promising, in writing, to appear in court for all upcoming proceedings. Leaving the state grants me extradition and tons of other goodies.

What were the words exchanged between you and the officer before handcuffed? The littlest things could make the biggest difference in any case. You should really give those details if anybody could really give some insight/advice. Hopefully you already have a lawyer, because that's who you should talk to. What was the reason for stopping you in the first place? Running a red? Avoiding a traffic signal? By the way, I saved me and my friend's ass last night. We got pulled over cause his truck had no tail lights. We literally just fucking smoked, and needless to say nervous as fuck. I hid my chillum, and as the cop was walking to the car, I saw my buddies grinder in the cup holder. Without thinking, I immediately said, "Dude the fucking grinder right there." I thought we were gonna be fucked, but my boy put it away without looking like he was doing sudden movements. Everything was cool after that.
