“They treated us very badly,” said her husband, Nelson. “No two ways about it.”
The Coniglios said the bank badgered them after they had fallen behind on their house payments, local station WTSP reported.
The calls didn’t stop even after the Coniglios told the bank that they had hired a lawyer.
The Coniglios sued under the Telephone Consumer Protection Act. A federal judge in Tampa awarded them just over $1.2 million, the report said. The bank’s expense was $606 per call, but the damages were tripled.

Without more details it's hard to say- but I doubt all the calls were unwanted. It just doesn't add up to me. It takes much less then 4 yrs to process a foreclosure. If it had gotten to the point where the homeowners gave up and said screw the mortgage stop calling me- the bank would have foreclosed.
What's more likely is they fell behind on payments, cought back up-rinse and repeat for four years.
It's a bit odd to say this but in such situations the bank should just pull the trigger. No need for unwanted calls- file the papers and repo the property.

Apparently its $600 per call, and then triple that for damages. I didn't know about that being a precedent until I read that Harvard Business professor story where he's suing a Chinese restaurant over a $4 overcharge and wants $12 in compensation.

Yes, they are a bank, which is a business. Businesses don't succeed by forgiving customer loans/debts. They didn't pay their mortgage, and the bank wants their money back.

It's meant to be a slap on the wrist for the bank so that they understand shit like this isn't tolerated, more than it's meant to be a reward for the couple.

How would that even make sense?
Maybe the arseholes should have taken the money they spent on their lawyer and paid their debt.
