Now there's a result I did not see coming, considering how all the evidence seemed to be stacking up against him. Still, it's a lose/lose situation. He's avoided the worst outcome, even if he's found innocent people will still see him as someone who'll shoot on the suspicion of a burglar without checking whether it's someone who's supposed to be in the house with him.

I'm watching the Judge hand down the verdict at the moment. It seriously sounds like the prosecution did an awful job. The verdict is still ongoing and can be streamed live here: [url]http://www.bbc.com/news/world-africa-29143540[/url] My guess is that he will be found guilty of culpable murder (which I guess is South Africa's version of manslaughter) as he was somewhat reckless in shooting through the door.

Really surprised by this. Was doing criminal law when the proceedings started and followed most of the prosecution and Nel sounded like he pretty much had him by the balls, he never really slipped up much. Hell, I was convinced he was going down for murder but I guess not, It'll definitely be culpable homicide though, no way could it be anything less.

The Judge gets to the point where she is mentioning his negligence and that a reasonable person would not have done what he did, and then she adjourned the matter. She is master troll judge.

They did pretty much the best they could with what they had. Nel has a tendency to be a bit brutal but that's just how he works. It was always going to be hard to try and use witnesses who only claim to have heard something that might have been screams, and to accuse someone of murder even after saying that they were in a diminished mental state. The more I think about it, the more i understand that it was probably going to be culpable homicide rather than murder anyway. You need intent for murder, did they ever have any evidence for intent? Shooting through a door isn't intent. You can shoot someone directly, with clear line of sight, and it's still not proof of intent to commit murder without some other factor(such as aiming for the head).
the reason he can't go down for murder is because there's no evidence that he shot specifically with the intent to kill that particular person. personally i think he probably knew exactly who he was shooting at but that's irrelevant anyways he'll still be going away for a long time hopefully. like the prosecution said - girlfriend or not, he intended to kill someone behind that door, whoever it was. that's not murder but it's still manslaughter. he's also broken a tonne of firearms laws and has had firearms issues with the police before in the past so he'll go down for that too

It's still far from over.

There was no doubt that he shot her, that why he is going down. The court had to decide if it was murder or manslaughter
