Apple has hit Motorola with a pair of patent infringement suits less than a month after Motorola attempted to stave off such an attack with a declaratory judgment action.
Late Friday, Steve Jobs and company unloaded suits against Motorola Inc. and Motorola Mobility Inc. in the Wisconsin Western District Court, as first reported by Patently Apple. The two suits wave six Apple patents, and none of the six were mentioned in the suits Motorola filed against Apple on October 6.
The first suit centers around US patent 7,479,949, which describes a "Touch Screen Device, Method, and Graphical User Interface for Determining Commands by Applying Heuristics." Yes, it's a multitouch patent. Apple claims that Motorola has infringed this IP with multiple handsets, including the Droid, Droid 2, Droid X, Cliq, Cliq XT, BackFlip, Devour A555, Devour i1, and Charm.
The suit also covers US patent 6,493,002, which describes a "Method and Apparatus for Displaying and Accessing Control and Status Information in a Computer System,” and 5,838,315, which details "Support for Custom User-Interaction Elements in a Graphical, Event-Driven Computer System."
The second suit covers three separate patents: 7,812,828 ("Ellipse Fitting for Multi-Touch Surfaces,” 7,663,607 ("Multipoint Touchscreen"), and 5,379,430 ("Object-Oriented System Locator System"). So, more multitouch.
Apple has made it quite clear that if it believes someone is infringing its patent, it will sue them. "We approach this business as a software-platform business. We are watching the landscape. We like competition as long as they don’t rip off our IP. And if they do, we will go after anyone who does," Apple COO Tim Cook said in January 2009. "We are ready to suit up and go against anyone."
The company has already sued HTC and Nokia. It appears that Motorola and Apple were discussing a possible licensing agreement to avoid litigation, but the discussions broke down before Motorola filed its suits in early October.
Really Apple?
Steve Jobs is an asshurt dick
They'll settle for some stupidly high amount of money and DROID continues to sell. It's the usual patent trolling.
Butthurt Apple being Butthurt Apple...what else is new...
Oh look, another one of Apple's lawsuits that will be thrown out.
Again.
I'm going to patent "gaseous agent used as a method for carrying oxygen through organic bloodstream" and sue everyone.
I'm going to patent, "System that slows down, harasses or trolls another company for a portion of a device thats on every device of that market." And sue Apple for its sue happy tendencies.
I'm going to patent "system of registering and protecting ideas"
I'm going to patent "system of registering and protecting ideas"
Dude, you should, as far as I know, there is no patent for patent registry and patent security methods.
Somebody file a patent for obnoxious black turtlenecks.
Yeah, because Motorola is suing them for basically EVERYTHING phone related. They're suing for MobileMe, the App Store, antenna design, wireless email, location based services and more.
oh yeah, let's not make a news post about how Nokia's suing Apple, Motorola, Qualcomm, Samsung, Sharp, Toshiba, Hitatchi, and LG..
Dude, you should, as far as I know, there is no patent for patent registry and patent security methods.
I wouldn't get it since it can easily be proven that somebody else thought of it before I did.

Two words: Tim Langdell. Now, you like me, might loathe the idea of abusing an already failing government system like this, but think of the possibilities!
You could shut down the US patent office and open your own, no more linked list patents taken out in 1998.
Patent wars.. Everyone is suing Apple and Apple is suing everyone.
More like everyone is suing everyone.
I bet Steve Jobs tried suing people for wearing black turtlenecks and jeans too.
:colbert:
I'm going to patent making shitty patent jokes in every fucking thread that mentions patents, since 2007. Honestly, its not new, its not funny.
Apple sells, but they lack business-ethics and a sense of respect.
That's why I hate that company, and why I'll never buy their products.
fuck apple
android OS all the way
** apple is just mad because they know that their OS is shit
Oh no their stealing out profits, Better sue quick
Wow we do not like someone let us troll sue the fuck out of them, yeah that is a great way to make money. Yeah the patent system for software is in a spiraling downwards into a pile of fail. Been for a few years now.
How the fuck is technology meant to advance with petty law suits like this being filed left right and centre?
There should be a two year grace period or something. If your company develops a new, innovative idea, you get the monopoly on that for two years. After which, other companies can draw upon that idea without being sued for millions, thus gradually advancing existing technology.
Motorola deserved it, they decided to sue Apple to get some profits, Apple is just fucking them back.
The US patent system needs to be sorted out, how apple managed to get a patent for those I have no idea.
fuck apple

You're a douchebag.
The US patent system is fucking terrible, and apple is a bag of dicks.

Nokia sued 99% of phone makers for shit that every phone has. It doesn't make sense anymore.
You're a douchebag.
for having an opinion that's anti apple? I'd say that's fucking honourable.
for having an opinion that's anti apple? I'd say that's fucking honourable.
Nope. For being an asshole. Opinion is: " I dislike iOS because it's closed", and not: "Apple fuxking sux and dey kno it"

How about apples abysmal business practices? Their methodology of being an incredibly socially conservative company? How about it's not only closed source, it's very much "Do what we let you"?
[sarcasm]Yeah, no one has a valid reason to hate apple... [/sarcasm]
