In other words: since their clone was released first, that makes it the original phone. The iPhone 5 is the actual clone, not theirs.
Makes sense? Of course it doesn't. Who cares! It's fun!

listen genius none of the patent lawsuits were "pointless". when you make a patent you're forced to defend it in court or else you don't keep the patent. it's a continual cycle of register patent, defend patent, register patent, defend patent.
the ONLY reason why Apple has been in the news for their lawsuits is because the words APPLE carry a big weight in the technology press that pulls shitloads of website views.
any technology company that has done ANY business in a large degree has sued and counter-sued and defended themselves in court when it comes to patents.
that is why the patent system is broke, it's not because your favourite company didn't win. this isn't a sports game where you root for your favourite team.
Google plays the same exact game in court as Apple does, as Motorolla does, as Samsung does, as Microsoft does.

One I find the most ridiculous is the patent for changing logos on specific events that Google got:

They might actually win, too. A company started cloning BMW X5s and managed to lose when BMW found out and sued. The cloned cars were so visually close that, if you put authentic badges on, the average person wouldn't be able to tell it from an actual X5.

I think it's stupid to criticize Apple too much for that. They're playing by the rules -- it's the rules that need to change. You can't set up a system with obvious flaws and then get sad when companies don't 'play fair'. Hate the game, not the player.
