Dude, what, no. I'm gay myself, what gave the impression that I meant it in any homophobic way? All I was saying is that it's not physically impossible for someone with X sexuality to do something outside their sexuality, and that doesn't mean that that is suddenly their new sexuality. Because sexuality is like an on/off switch that is either fully on or off if all the requirements are met. Because anything in the human mind works like that.
This is why I don't want to believe in sexuality. There are so many things in the world that we simply can't define with rules, and a big portion of the human mind is one of them.

Because homosexuality is not a medical condition, homosexual behavior is not considered a symptom, and therefore homosexuality is not, by definition, a psychiatric disorder.
I don't know whether or not psychiatric terms are indisputable within US court rooms, though. In cases where mental health is brought up in the court of law, a psychiatrist who has interviewed the (usually) defendant is present and is able to testify (usually.)

According to the American Psychiatric Association, the term "medical condition" can refer to all diseases, illnesses, and injuries except for mental disorders. Homosexuality, like sexuality in general, would probably be in the realms of psychology. So it would never be considered a medical condition, but that doesn't prevent it from being labeled a mental disorder.
So your conclusion is a bit wobbly. There's probably a better way of showing that homosexuality is not a disorder.
