If the entire weight of the internet came down upon your doorstep demanding a look around your entire existence, I'd probably forgive trying whatever damage control that the person could do. The girl never filed charges, so eh. It's rather pathetic that so many people were distracted away from important issues, children missing, etc. To find a goddamned couple.

While I don't personally disagree with you, the law in some places makes exceptions that basically state people who intentionally get intoxicated and have otherwise consensual sex aren't being raped.

I hate this shit. Dude was drunk too. I don't think it's so simple as "if the female party is drunk she can't consent", maybe by the law, but it doesn't make fucking sense. At that point you might as well make it rape for both involved if they don't sign a notified contract while sober before engaging in coitus.

You can't deny that a properly drunk person is in no condition to consent though.
If they're dating though, that's a different story I suppose...? And who gets "raped" depends on the person who "attacks", or makes the first move.

Contrary to popular belief most court rooms take the intoxicated-ness of both parties into account when determining consent and criminal culpability. If both parties were intoxicated it really can come down "Well who was more drunk? Would this person have been able to reason that they were given consent in this situation? Was the 'sexual assaultee' intoxicated enough that they made a dumb choice and it was drunk sex?". Drunk people can still consent but it can come down to the time, place, and level of drunkness on both parties. I've sat in on a couple of sexual assault trials and I'm also a sexual assault forensics examiner.
I think you should be responsible for yourself even while drunk, period, it's not like if I get pulled over for drunk driving I'm going to say " But officer I would never do this if I were sober, please let me go free"
