A human sexuality professor at Western Nevada College allegedly required his students to masturbate, keep sex journals and write a term paper detailing their sexual histories in order to receive a passing grade, according to a federal lawsuit obtained by ABC News.
Karen Royce, a student enrolled in the human sexuality class, filed the lawsuit in the U.S. District Court of Nevada Monday because the professor, Tom Kubistant, reportedly disregarded her complaints that the class assignments invaded her privacy and amounted to sexual harassment.
“I raised my hand and said, "I don't masturbate," Royce told KRNV. "He said I had to do it at least three times in order to get a grade in the class."
On the first day of class, Kubistant allegedly told students that he would "increase their sexual urges to such a height that they won't be able to think about anything other than sex."
Kubistant reportedly then asked students, some of whom were high-schoolers taking the course for college credit, to list different types of sex and sexual positions, according to ABC.
The lawsuit alleges that the professor read the lists aloud to the class and then asked the students to write three 250-word journal entries about their sexual thoughts for homework.
Kubistant also reportedly assigned a 14-page term paper which required students to detail sexual exploration, abuse - including rape - virginity loss, cheating, fetishes and orgasms, among other things, ABC reports.
Royce’s attorney, Ken McKenna, said that the 60-year old, who was returning to school to become a social worker, was not aware that students were going to be required to discuss their own sexual experiences.
"Not only was she shocked by the assignments [AND] the personal inquiries, but she herself had been a victim of sexual abuse," McKenna told ABC.
Students, however, were asked to acknowlege that they were aware of the class’s graphic nature in a waiver on the first day of the course.
Royce, who dropped the course after four classes, admits she did not read the waiver before she signed.
Royce names Kubistant, department chairman Robert Morin and college president Carol Lucy in the lawsuit.
The college launched an investigation into Royce's claims after she told administrators that Kubistant dismissed her concerns.
An investigator reviewed the syllabus, interviewed students and found the claims to be unsubstantied.
Professor Tom Kubistant allegedly told students that he would "increase their sexual urges to such a height that they won't be able to think about anything other than sex."
"In fact, the investigator found that the instructor was considered to be an excellent and caring professor, who, with the exception of that one student, appeared to be universally admired by other students who had taken the course," the college’s spokeswoman Anne Hansen said in a statement.
Royce appealed to the U.S. Department of Education’s Office for Civil Rights when the investigation ended.
In a letter dated Jan. 25, the office said it agreed with the college's investigation and would not pursue Royce’s claims any further, according to ABC.
Royce then decided to file a federal lawsuit, which McKenna expects to be heard in court in a year.
"I think he needs to be terminated. He has crossed so many ethical, legal and moral boundaries," McKenna said. "My mind immediately went to the question is he grooming these young 17-, 18-, 19-year-olds so he can have further contact with them outside the school environment?"
Kubistant did not respond to requests for comment and still teaches at the college.[/quote]

I dunno. Something feels off about this article. The teacher is clearly strange, and probably needs to be leashed in quite a bit, but she had ample warning to how the class would be, and decided to go into it anyway despite the possibility of something triggering her.

She didn't read the waiver before signing the thing, it's her own fault. It's very unfortunate for her that she was put into this situation, but what did she expect from a class in college about sexuality? College is a place where topics are able to be discussed in their entirety, free from most of the restrictions high schools and such place on them. Everyone's an adult there, and they know what they're personally able to talk about. If you can't handle it, leave, right then and there. No professor will stop you.

The waiver explicitly says what will go on in the class. If you have a problem with any of it, you don't sign the waiver and you don't take the class.
Signing the waiver / taking the class means you implicitly consent to everything on said waiver, ergo you implicitly consent to everything that will go on in the class.

This is a textbook case demonstrating that society is completely terrified of human sexuality. Instead of embracing a class that explores it (within bounds that the students [i]agreed[/i] to), everyone just accuses the professor of being a predator and a sicko. Until there's [i]proof[/i] he did anything wrong except conduct his class, I see nothing wrong with the contents of the course. And in fact, there was already an investigation which found nothing.

She is in the wrong because she didn't read the waver, but she was a victim of sexual abuse, it's a perfectly rational assumption she would be somewhat disturbed by the idea of sex. Think for a second before you go off about something stupid.

At any rate, if all this information was on the waiver and the student signed it, then it's the student's fault. This kind of course content might be generally unexpected but it's your fault if you don't read the information beforehand.
