Help me remove strange black background from scanner

Hello world!
I got my picture taken a few weeks ago. And I've been playing around with the picture in Photoshop. This is what I came up with: [url]http://i.imgur.com/X9oap3M.jpg[/url]

But I cant get that ugly background fixed! It should be black, but not so buggy like that. Can anyone help?

spent about ten minutes so the top part of the hair was kind of lazy but maybe you can do something with these
