Just as Alabama was set to become the 37th state to enter legalize gay-marriage, a judge has ordered
Alabama Chief Justice Roy Moore Sunday evening ordered probate judges in the state of Alabama to not issue marriage licenses to same-sex couples, setting up a potential showdown between Alabama's chief justice and the federal courts.
The six-page letter, issued hours before same-sex marriage was expected to become legal in Alabama, says "no probate judge shall issue or recognize a marriage license that is inconsistent with Article 1, Section 36.03, of the Alabama Constitution or § 30-1-19, Ala. Code 1975." The named sections refer, respectively, to the state's 2006 constitutional amendment banning same-sex marriage, and the 1998 law doing so.
U.S. District Judge Ginny Granade struck down both the law and the constitutional amendment in two decisions on Jan. 23 and Jan. 26, saying they violated same-sex couples equal protection and due process rights under the 14th Amendment to the U.S. Constitution. Moore's order comes as a stay of Granade's decision was set to expire; as of late Sunday evening, the U.S. Supreme Court had not acted on a petition from the state seeking an extension of that stay.
Alabama is one of the last places I would ever think could legalize gay marriage. Isn't the stereotype down there supposed to be that they're all racist, god-fearing rednecks?

Still sucks that this happened though. Massive dick move.
what are they so afraid of
US Constitution > Alabama constitution. Someone tell this judge about that.
I somehow knew Alabama would take extraordinary measures to kick and scream and keep gays second-class citizens.
what are they so afraid of
The destruction of their way of life and, um, being forced to gay marry their dogs or something.
Basically it's a bunch of bigots clinging to their backwards social biases.
Another case of a state member claiming that federal jurisdiction is not above them.
This ought to result in immediate removal from office, but of course it won't.

I doubt he gives a shit
anti-gays are usually pretty extreme about it

There sure are a lot of people who have extremely sick ideas of what the law should do regarding gays
banning them is bad enough as is

Alabama is That and in the larger cities, of urban persuasion. Montgomery is basically one big ghetto. And outside the big cities it's basically Duck Dynasty. There's a couple nice places, but not enough. The state is just bleh. Ever drive down I-65 through Alabama? Near Birmingham and Montgomery, you'll feel like you took it in the ass. They're terrible
THEM FAGGOTS IS IMFRINGING ON MAH GAD DANGUM RAGHTS!
Is obviously what they are saying.
And everybody wonders why Rufus Clint Lynchem of Killdeer Alabama struck it down.

A federal district judge is more progressive than some other federal district judges. That's all that is.
now, admittedly i've not been following the legalization of gay marriage across the states, but i think it's ridiculous that it's somehow still not legal across the country.

Alabama, Georgia, and Mississippi are the assholes of the South. The rest of the South at least has some sort of charm.
Except Florida.
Fire him and then arrest him. This is contempt.
A federal judge has issued an order, he is a state judge and is legally bound by the supremacy clause to uphold it.
legalize gay marijuana
Roy Moore is a hilariously bigoted bastard. But I'm also pretty sure he fully lacks the authority to do this as a Federal Judge, higher than a state judge, already declared the ban unconstitutional and ordered probate judges to start issuing licenses after the stay ended. Basically, he's issuing something he lacks the legal authority to enforce near as I am aware.

According to the story, he's pulled this shit before. Old fuck's got a listening problem.
Moore has tangled with federal courts in the past. In 2003, Moore, serving his first term as the state's chief justice, refused an order from U.S. District Judge Myron Thompson to remove a monument of the Ten Commandments from the Alabama Judicial Building. Moore's defiance led to his removal as chief justice later that year.
SPLC President Richard Cohen, who has filed an ethics complaint against Moore over his public statements on same-sex marriage, accused Moore of "creating a crisis in our state."
"We urge the probate judges to follow the Constitution of the United States and issue marriage licenses when their offices open in the morning," a statement from Cohen said. "Chief Justice Moore has no authority to tell them to do otherwise."
Hopefully this second time will see him kicked out entirely.

south mississippi is a downright pleasant place to be. it used to be if someone up north found out you were from biloxi or bay st louis or whatever they'd be downright disgusted because of all the debauchery that used to happen around here.
And yet same sex marriage licences are being issued today:

Supreme Court is not having any of this ban crap right now. Looks like they are on their way to allow it nation wide this summer.

I lived in Alabama for a year and I still can't believe they voted this insufferable moron in.
A man who openly and unquestioningly ignores and defies any court order or action that goes against his personal beliefs.
I can't wait for him to be forcibly removed from office again. Fuck him.

I'm in love with the term 'practicing homosexual'.
I'm in love with the term 'practicing homosexual'.
The man honestly believes that Alabama's sodomy law is constitutional, legal, and has not been struck down twice.
Also, fun fact, men cannot be convicted of raping another man in Alabama. Until the 80s, it was also impossible to convict a woman of rape.

Little do they know this is our secret weapon for when we don't get gay marriage by a certain quota.
I guess Alabama can secede, then. Don't give them to us, though. Just invite Russia or China over, they're always looking for more territory.

Mississippi isn't so bad on the Gulf Coast. Biloxi, Gulfport, Ocean Springs, and Pascagoula feel like you're in a different state. The education is better, the culture is different, and it's much more pleasant then say Horn Lake, or the entirety of DeSoto County, MS where it's full of crime and idiots. And the Delta is another subject.
now, admittedly i've not been following the legalization of gay marriage across the states, but i think it's ridiculous that it's somehow still not legal across the country.
Welcome to America, where states' rights have resulted in a clusterfuck of a system needlessly complicating the legality some of the most simple issues of basic civil liberties which should be respected nationally.
But like others have pointed out, this old dude's call isn't going to hold up. Gay marriage is a thing now. Deal with it, guy. It's here's to stay.
now, admittedly i've not been following the legalization of gay marriage across the states, but i think it's ridiculous that it's somehow still not legal across the country.
US has the 10th amendment, which leaves these rights up to the states themselves, but can be overruled when necessary. It's sad these states cannot allow an optional thing to happen in their state. And really, legalizing same-sex marriage wouldn't change anything. It'd just allow same-sex couples to legally marry, how people a heavy negative in this continues to shock me.
Then again, this decision is coming from a state in the bible-belt. If same-sex marriage was put through there, citizens would have an uproar for no reason other then it apparently infringes on their rights and now it's of their concern, even though it doesn't affect them one bit.
