Even Samsung’s Lawyers Can’t Tell the Difference Between Its Tablet and an iPad
Apple says Samsung's blatantly ripped off its device designs. Not true, Samsung replies! Too bad its lawyer blew that argument harder than a hydrogen bomb blowjob: they couldn't tell the difference between a Galaxy Tab and iPad. In court.
Reuters reports the horrific embarrassment: when a Samsung attorney was asked by U.S. District Judge Lucy Koh whether they could tell which tablet was which, what was the response? "Not at this distance, your honor."
Gulp. I really can't imagine any possibly worse answer, other than saying, "There is no difference, your honor. Please ban us from selling our products. Please." What followed might be even more painful:
"Can any of Samsung's lawyers tell me which one is Samsung and which one is Apple?" Koh asked. A moment later, one of the lawyers supplied the right answer.
Christ. What can even happen from this point forward? How can Samsung's legal team look any judge in the face and argue that their device didn't copy the Apple product that came before it? Whether this copying is illegal in its extent is for the court to decide, but today, Samsung essentially admitted the Galaxy Tab is identical to the iPad. Apple must be feeling smug, even if they're not getting their massive American injunction (yet).
Bad eyes.
How is that even an argument in their favor. I can't tell a Sony Ericsson from a Nokia at 5 meters either.
nvm, picture in the article is broken.
...what the fuck? what the fuck is the guy who wrote that article on
he couldn't tell which was which from a distance so that means samsung ripped off apple??? I probably couldn't tell an iPhone 4S from an iPhone 4 at a distance, does that mean they're the same thing? (actually, don't answer that)

just more abysmal shitty journalism from gizmodo, nothing to see here chaps
How is that even an argument in their favor. okay if I'm going to make a post which isn't just furious ire, this seems like the lawyer was somehow badly unprepared
the difference is very obvious if you've seen them both before and know which is which - you need to be fairly close to them and having the thing actually turned on would help
seems like an honest but faintly embarrassing mistake, but nothing to go "oh holy shit jesus this is the end for samsung!!!" about
Uhhh so I guess apple patented "a black frame around a screen"? You could aswell put two same size and colour LCD panels next to each other and ask the same question.
Electronic devices generally look similar, why fix what isn't broken. At a certain distance monitors, tvs, phones, whatever all look pretty much the same.
I still liked the Samsung counter sue saying apple took the iPads design from Kubrick.
Gizmodo is no longer a valid Sensationalist Headlines website.
along with gawker, kotaku, etc
Yep, Samsung's lawyers royally fucked up. Get ready for an injunction banning them in the US too.
Our judges don't know shit about technology, so they'll listen when the Apple lawyer says "See!? Even they can't tell them apart, they totally copied us!"

I can't tell the difference between a tablet and a picture frame to be honest with ya.
Apple seeing based on hardware is amazingly stupid. All only-screen devices will look the same in some degree. I think Apple has a point when it comes to software though. Samsung changed Android to look a lot more like iOS. Using my dad's Captivate for a year, it is pretty obvious what Samsung tried to do. Either way, this article is pretty stupid.

10 bucks Apple used another one of their magic photos

I'm going to manufacture monitors and then sue people who make monitor which look like mine!
Stupid bloody look and feel patents.
It looks rectangular and it feels hard, SUE SUE SUE!
I don't get this patent. Did they patent round corners? Rectangles? Touchscreens on rectangles?
apple pwnd samsung.
deal with it facepunch

How about no?
It's a fucking rectangle and this whole suing business is retarded. You can't pwn someone if the argument was flawed to begin with.

the argument is that there was no differerence
the argument is that there was no differerence
And they look similar, yes. But what I'm saying is, so does everything else. Apple's popularized a design, and now they're reaping the benefits. It's a slimy way of business.
the groveling and apologetics towards samsung is kinda cringe-worthy and pathetic to read, just putting that out there

Uh, how?
This is stupid
the lawyer obviously didn't do his research beforehand

Orrr he just had bad eye-sight. I mean, if your vision's bad enough a sheep can look like an elephant, much more so at a distance.
Orrr he just had bad eye-sight. I mean, if your vision's bad enough a sheep can look like an elephant, much more so at a distance.
This isn't much of a distance and if you look at pictures of the two tablets it's pretty easy to tell them apart head on purely based on their shape
(the iPad is wider)

hey I don't usually take sides with faceless corporations but you can't deny that apple (or at least their legal team) are being unbelievable dickheads about this whole thing
whatever happpened to actually improving your product to deal with competition?
[editline]14th October 2011[/editline]
even fucking google called them out on it

Well if they look so obviously different, why does that mean he didn't do his research? If anything, that's further support for bad eyes.

they're both dickheads.
what i am saying is even if there was any violation of anything if it involves apple people will automatically assume a position on the matter regardless of what anyone says.
i'm just glad we have courts that deal with this bullshit.
