OSHA spokeswoman Leni Fortson said she could only say that the agency is investigating the accident and is looking into both companies. OSHA does not comment on open investigations, she said. Colavitti said Monday the contractor did not have a building permit, which would have triggered a safety inspection before or during the roofing work. Swepco did not have any outstanding fire code violations, and the building’s last fire inspection was in December 2011. The chief said over the years, acid steam and mist ate away at the corrugated metal roof above the tank, so the roof needed to be replaced. The roof replacement work has been shut down, but the factory remained open Monday. Swepco was among the top polluters in Passaic and Bergen counties last year with 1,832 pounds of toxic chemicals released into the air, according to the Environmental Protection Agency’s Toxic Release Inventory Program. The inventory cites nitrite acid as the plant’s top chemical and reported that air emissions were more than 10 percent higher in 2011 than in 2009. But air emissions from the plant have declined in the past several years, government data shows.
