• Man Claims Meth Lab Was For Weight Loss And Is Freed By Judge

But magistrate Gordon Lerve said in Albury Local Court yesterday he had trouble accepting such a submission. Kelly, 52, appeared for sentence on a charge of manufacturing a prohibited drug. Director of Public Prosecutions representative Sue Maxwell said [B]it was less than the indictable quantity. “There is no quantity. He never got around to making the amphetamine,” Mr Murnane said.[/B] Kelly was remanded in custody with bail refused and remained there until bail was granted in March last year through a delay in the forensic chemist’s report. Mr Murnane said Kelly has a long history of depression along with back and shoulder ailments. “In reality, he did not have the skill to do what he intended doing,” Mr Murnane said. Kelly had been a train driver for 12 years, was ashamed of his behaviour and was likely to leave Albury when the matter was completed. [B]Mr Lerve said he had trouble accepting that Kelly’s intention was to use the drug for weight loss.[/B] There was some degree of sophistication with the drug laboratory.
