AFAIK, under the RICO act, Phil Fish and anyone associated to this could definitely go to jail for fraud and racketeering.
The people who dug up this information also strongly suspect that the origin of the Polytron "hack" was actually a Polytron employee who found out about this and was upset with Phil.
Blow is currently denying his involvement.

alright i don't know enough about the law but i looked up racketeering and it doesn't sound anything like what they're accusing them of so I'm kinda confused, especially the supreme court case which deals with the government censoring the news??

One helluva coincidence to fund a game(s) production, then be on a judging board for said game(s), ensure said games win the thing you're a judge on, and said game(s) subsequently go on to be hits in the indie gaming scene.
