North Dakota files suit against gay marriage ban, making it the last state to do so
According to CBS News, seven couples have filed a federal lawsuit challenging the ban on same-sex marriage in North Dakota.
The suit was filed today at the U.S. District court in Fargo.
It challenges both North Dakota's constitutional ban on gay marriage and its refusal to recognize marriages of same-sex couples who legally wed in other states.
The lawsuit means cases are currently pending in all 31 states with gay marriage bans, because North Dakota was the last remaining state without a court challenge.
Judges have overturned several of those bans since the U.S. Supreme Court struck down part of the federal Defense of Marriage Act last year.
Minneapolis-based attorney Josh Newville, who is representing the North Dakota couples, also filed a lawsuit on behalf of South Dakota couples in May.
I've been seeing headlines about this in the paper for the past few weeks, but it's nice to actually see it finally go through.
Title is a bit misleading, this is a lawsuit against the North Dakota ban by couples in the state, not by the actual state. Trying to get that fixed.
North Dakota is going to be a hard one to deal with, but with the increasing LGBT population through out the capital and oil fields, we'll probably see the anti-LGBT laws overturned.
The title is a little misleading. People are filing suit against North Dakota over their same-sex marriage ban.
Not to be really anal about the title, but isnt every state that last (or latest) state when they first filed?

The title means that out of all states that ban gay marriage, ND is the last one where it is challenged. There are no states left with an unchallenged gay marriage ban.

uh the fuck does that mean?
you still can't gay-marry in half the country.

it means the laws are challenged not that they're overturned
Should have made the title a bit more clear that it is a suit against the state's marriage ban, tried editing but it didn't seem to do any good. And North Dakota was the only state in the US for a few weeks now without an unchallenged ban, so they would be the last ones to actually take it to court, even if they're not the last ones with it fully legalized.
Is this the slippery slope they argued about last year? Cas this one is good not like the one scalea thought would happen
They want to ban gay marriage bans, so the other side will want to ban banning gay marriage bans.

They're going to court. There's currently a lot of pending cases, which is why about every other week you see a headline like "Federal Judge Strikes Down X's Gay Marriage Ban"

Because the suits are still in progress. They just started earlier. ND is merely the last state where the ban itself was challenged.
